PIP, Workers’ Comp to be Considered in Fla. Special Session

The Florida Insurance Council reported that committee members in the state’s House of Representatives are beginning work in a special session on two bills not related to state spending—workers’ compensation and PIP/auto insurance. The Florida Legislature has convened in a special session to work on a new state budget.

The special session is expected to run through May 27.

The House Insurance Committee is expected to take up workers’ comp and PIP packages. The auto insurance proposal is based on the bill passed the Florida Senate in the final days of the regular session, but did not come up in the House. It sunsets PIP in 2003, expands the demand letter, pre-suit notice and has other important provisions, but does not include a medical fee schedule and peer review. alternative dispute resolution mechanisms.

A workers’ comp plan was nearly passed in the regular session, but the package to be considered during the special session is reportedly different than the previously one.

The FIC noted that if the two bills don’t pass during the current special session, they may be considered during a subsequent one.
