Class Action Suit Filed Against AIG Over Katrina Claims

    We have serious damage to our roof from hurricane Rita and there’s water damage inside our home. The FEMA blue tarp people have come, so hopefully, the temp repairs will keep more rain water out for now. We have some mold, but we are squirting it with chemicals and trying to keep it down as best we can. We have cracks in our rafters and other problems suggesting structural damage. We are not poor, but we have four kids and are not rich either. We got upset with Allstate several years ago and didn’t realize nobody was issuing homeowners in Louisiana. We had no idea telling Allstate to take a hike would leave us stuck with with Louisiana Citizens Fair Plan. It was october 1 or thereabouts when I called to make a claim and was given a claim number. Everytime I call back they say my claim is still being processed. Apparently no adjuster has been assigned to us. I’m now wondering if I will have to get a FEMA/SBA loan to repair my house and pay it back down the road when FAIR plan gets it together. I’m guessing the state insurance commissioner and/or the courts will eventually figure out how to make them pay. I’m trying to get roofers and others to give me estimates on repairing the damage. RE: Fair Plan–Is it time to panic or is it all going to work out? I wonder if the state legislature can do anything to make them more responsive.

    It appears that the only way that the Fairplan service can get worse is to outsource it to India.
    SP – Re: 2 years. My reference to two years is the Texas plan. Sorry for my confusion. They need to re-name the fair plans…it appears they aren’t capable of being very fair. What’s fair anyway? It’s a stupid name. It’s too early for this I just feel like grumbling.

    I GUESS I’M IN THE SAME BOAT AS THE OTHER WRITERS IN THIS MATTER. I PUT THE HOUSE IN QUESTION IN MY NAME IN JULY, PAID THE INSURANCE PREMIUM, GOT AN ID NUMBER THEN THE PROBLEMS BEGAN. I PURCHASED THE POLICY THROUGH ALLIANCE INSURANCE AGENCY SERVICES. TO MY KNOWLEDGE I NEVER RECEIVED A POLICY FOR MY MONEY! SO WHAT GIVES IS THIS A SCAM BY AIG OR WHAT?

    Dear Herb, We have had a little detail like Hurricane Wilma, which just hit us on Monday, which explains my late response. Did you receive any paperwork in exchange for your check? Usually there is a \”binder\” in the paperwork, which is absolute, positive proof of insurance for a stated amount of time, for example, 45 days, which gives time for the insurance company to look everything over, and issue or deny the policy, but still with the 45 days of coverage. I would check to see if you can find that binder. Also, even with the FAIR plan, there has to be a series of letters to you that, if they do not accept your application as is, which tells why, and when your coverage will end. If your check was cashed, and received nothing back in the mail, you probably have insurance. I would go ahead and file a \”claim\”, even though you may not have gotten a policy. Was it delivered to the wrong house, was it lost in the mail, etc, etc, etc ? Try to find your binder or paperwork, and also file a claim. Name and address should be sufficient. If you get an adjuster assigned to you, MAKE SURE that you get his cell phone so that you can politely pepper him with questions and ask him how to get things done.     Thank you James. I\’m currently trying to get a policy with State Farm. Once I get the damage cleaned up it should be ok. Unfortunately I\’m not going to get any money from Fairplan to fix anything. But at least they won\’t be taking my money anymore. State Farm actually costs less per month and has better coverage, but at the time we first applied for it they were not taking new customers.

    I tried probably 20 numbers to call for an adjustor. No response. I also got 2 phone calls from AIG stated that if I don\’t get any phone call by….., please call me back. Absolutely I called them back and they said \”Please do understand this situation, everybody is waiting too\”
    What should I do?

    Please tell me how to get in on this class action suit. I filed my claim on Sept. 6 and I have not been assign an adjuster. The number they gave me to call was 225-744-4166, the people there are a joke. They will tell you anything to get you off the phone. It\’s been \”WE don\’t have a claim for you\”, or \”You have not been assigned an adjuster\”, and this is the one I just love,The supervisor, Kie Kie, says \”You\’re with Team H, I have three telephone numbers for you to call so you can set up an appointment\”. Well the numbers are Nextels\’, each has the same voice mail message, you can\’t leave a message, so you are back to square one. On October 18th my agent sent an e-mail to Citizens Website Feedback, explaining the difficulty in getting someone to call me. A P. Pursnell of Property Insurance Association of Louisiana forwarded the e-mail to J. Boudreaux, S. Jackson, and C. Mathes asking for someone to contact me concerning an adjuster. The next day I got several calls, all saying my information would be sent to central claims and I should hear from someone in 48 hours. That was on October 19th and I\’m still waiting to hear from someone. Please send me information on how to be included in this class action suit.

    I did called Ray Orrill for class action. His number is 504-2998724 and 337-237-8200. I had sent him all information but haven\’t heard anything from him. Or this lawsuit is going to be the same as LA plan. Gone with the wind.

    I have an idea. Before we get the insurance department to find out what\’s going on with the so-called \”fair\” plan, let\’s pile on expenses so the fair plan is more insolvent than it already is and then even people without claims will share in the money grab. Of course people with real claims won\’t get paid much.
    Now that I\’ve spouted off, here\’s a SERIOUS QUESTION
    Has anyone got any answers from the different departments of insurance on what\’s really going on? Or have the commissioners of these departments run away?

    I have experienced the exact same behavior as you all have experienced. It was totally unbelievable that I had been pushed from one phone number to another trying to get a live person to answer the phone. That message of \”due to katrina, we will not be able to take your call now\” was the icing on the cake. I was told that AIG was one of the biggest insurers in the world by a representative of the insurance company himself, i.e., attorney. What a joke that was. My house had never flooded before and our family is not poor either. Are we all going to get totally ripped off by this worldwide company or what?
