    While it is true the low level minions of the insurance industry make these decisions, the policy directing them to make these decisions comes directly from the top. Institutionalized Bad Faith. The Ins Co. CEO\’s are multi-millionaires from this. You rip off ever claimant by $1,000 or more and the numbers are staggering.

    10 Million, 20 million, 30 million. Whatever the maount, if insurance company is screwing people over they should be hit hard enough to cause them to reconsider their practices. The problem I have with this case and others like it is that you have what amounts to millionare socialism. The insurance company gets hit for a large amount that is transfered to the defendant and legal team, making them rich. Sure the defendant should be justly compensated. But to give them millions of dollars? I\’m all for hitting the insurance company hard, but can\’t there be a better use for that money besides enriching ambulance chasers and their prey that live in John Edwards\’ other America?

    Tim, are you currently working in claims? Do you work in the work comp area? If so I wonder if I might get some input from you. I am a lawyer and have been asked by the department of labor to give a presentation to a few hundred insurance claim handlers in May about the subject of bad faith handling of work comp claims. I generally work on the other side, i.e. I represent people against insurance companies. I am trying to devise a presentation for these folks that will actually be helpful to them, and will challenge their way of looking at the claims process, without being antagonistic. It helps me to visit with claims people.

    The answer to Bubba\’s question is found in his query: SOCIALISM. I\’m guessing you don\’t want that. Until the government (actually and legitimately) regulates the insurance industry, the only way to stop this nonsense is to make it prohibitively expensive to do business that way. By the way, Bubba, John Edwards has done monumental work for the less fortunate in our society- as a lawyer, a senator and most recently in his one america foundation. What have the CEO\’s of ins companies done? Progressive\’s CEO earns 25 mill a year. The company owns the largest collection of modern art in the US.

    I\’m sorry, but what a bunch of crap. \”Millionaire Socialism\”? What does that even mean. If the man was totally and permanently disabled and had a 20 years or working left, and had huge medical bills and had huge attorney\’s fees, it could very well add up to 10MM.

    It so nice to read/hear/see a voice of reason like Tim in a sea of idiots. Most people crying on here have never worked in claims or have handled litigated claims so they make up b.s. like Mike and Jeremy to suit their own agenda. If you people out there believe that fraud is not heavily prevalent in insurance claims then you are more naive than you think.

    We know there\’s fraud in insurance. It runs both ways. On the whole, insurance companies commit way more fraud than individuals. But, the truth doesn\’t fit into a tort deformer\’s agenda.
