Court records show the lawsuit was brought by Justin Brown's parents against the driver in the fatal accident, Evan Kimia of Greenwich, who was convicted of second-degree manslaughter with a motor vehicle and is serving a four-year prison sentence.

Brown was a passenger in Kimia's car when it struck a tree and stone wall. Authorities say he died of head injuries, and Kimia's blood-alcohol content at the time of the accident exceeded the legal limit of .08.

Kimia's lawyer did not respond for a request for comment. Kimia apologized for his actions at his sentencing hearing.
