Woman Files for Class Action Lawsuit over Contact Lens Solution

A lawsuit seeking class action status has been filed against a company that is voluntarily recalling a brand of contact lens solution.

Nicole Lazar, a resident of Santa Clara County, Calif., was named as the plaintiff in the lawsuit, filed on behalf of California consumers who bought Complete MoisturePlus solution but were not injured by using it.

The lawsuit seeks reimbursement for the money plaintiffs spent on the solution and the cost to replace it after the recall.

On May 25, government officials warned people to throw away the multipurpose solution from Advanced Medical Optics Inc. after an investigation linked it to a rare eye infection.

A company spokesman said it does not comment on pending litigation.

Last week, a 37-year-old man also sued the Santa Ana-based company, claiming he developed Acanthamoeba keratitis, a painful eye infection caused by a waterborne organism, in August 2006, while using AMO Complete Moisture Plus. His lawsuit seeks unspecified damages.

The Centers for Disease Control and Prevention the U.S. Food and Drug Administration are investigating 138 confirmed cases since January 2005.
