    To explain your broad statement,

    You obviously aren’t well informed. If you were it wouldn’t need an explanation.

    Your comment about me being illegal and my 24 relatives clearly shows you are a racist. I was born here and I am not Hispanic. I am as white as you can get.

    How about your tax dollars going to support illegal activities all over the world. Again get your priorities in order. Wake up or it will be too late for us all.

    America is not for everybody. I would hate to see you suffer in this country if you didn’t like it. Don’t sell yourself short, move to a country you will be happy in. Canada might take you in, it may just work. Good luck.

    FINE as long as the employers that hired these ILLEGALs go to JAIL. This would stop this kind of abuse of our tax dollars by keepinf the ILLEGALs out, so we would not pay for all there freebees. Yes I know W.C. is not free.

    Could some clue me in on how the illegals are not paying taxes? Do they check off their W9 “wetback” so none is withheld? At 7/11 announce “I love Vincente Fox” so no sales tax? Come on guys talk about taxation with out representation the illegals are a gravy train of taxes with little services (deport em if the try) provided. Outside of the lunatic fringe comments I assume if some one drives over here and is in an accident they deserve to have our laws and our rules waived because they are an illegal; maybe call them a detainee like the feds have and throw away the keys (and constitution).

    If they are not here legally, they are not paying taxes on what they earn. If they rent, they usually have 4 to 15 people in one apartment or house and at least 8 of them are children going to school free for a few dollars of tax via rent.

    Without knowing all the facts of the case I agree that Farmers Coffee should possibly receive fines and penalties. Perhaps Farmers Coffee should also be responsible for the injuries to the worker, but I do not believe the California Courts should have the right to go against the language of the workers compensation policy.

    How many people live in the home or how much taxes they pay (given our mediocre tax laws) is irrelivent. The only relivent thing is that they are illegal and that is where were it ends. Their color, ethnic background or living mode (given it is legal) is irrelivent. We must not reward illegal behavior. Notice that a huge proportion of prinson inmates are illegal. Why? Because they thought if they can do one illegal thing, they think they will get away with anything illegal. George Bush is dead wrong to keep letting this happen, the liberal San Francisco courts are also wrong (and I am within striking distance of this city of no morals). We needs to stand up for what is right, not what is wrong.

    Wow… lots of issues today…

    1) Remove the emotion, racism, and irrational comments, and make this a business debate forum with professionalism as it belongs to be treated.
    2) Employers that knowingly hire illegals should suffer the consequences, both in the policy exclusionary language, and the penalties applied by the government. We don’t know what happened here, but if they knowingly hired, then address that issue, on it’s own, in dealing with the employer only.
    3) Separate the “wrongs” here. Regardless of how the employer behaved, deal with the employee according to his own actions. If he is an illegal, then he does not deserve treatment as a citizen. He should be given no status in any civil court as a plaintiff. He should be deported. While that sounds like the employer “got away with something” on the WC side, that’s just not true. If they hired illegally, nail them on that issue. Then again, there is quite a business in providing false documents, and employers can be duped — so don’t punish them because they were defrauded by a criminal.
    4) Get political, and learn the basis for the problem. If the illegals were all deported on the same day, we might not function the next day here in the southwest… because our citizens will not TAKE these jobs (or at least certainly in the numbers required). Work with politicians to support the ones that are trying to create logical worker programs. This labor force is valuable to us, and if we do it right, those that are illegal now would be happy to BECOME legal, thereby fueling our future workforce with hard-working well behaved citizens.
    5) Illegals do pay SOME taxes, but don’t think for a moment they pay their fair share, just because they have something deducted from their payroll check. Typically they claim the highest dependents, etc, so they pay the lowest tax rate possible. That’s not right. Yes, they pay things like Sales taxes… but just because they pay SOME taxes does not mean it’s fair. And don’t claim that they do not have representation, either — because they do find ways to do that as well, with documents and voting that is not as secure as you might like to discover.

    Yes, probably four or more WORKERS are living in an apartment as the minimum wages they earn to not allow them to rent a luxury condo. Come on, these guys are working jobs no one else will take and that are pretty dirty and low pay. They do not import their family and grandparents cousins etc, they send most of what they can back home. I repeat, how do you come across with they do not have to pay taxes: wages are withheld, seems the government wants its cut for social security, state tax, SDI etc unless the firm has really gone around the bend.

    Secondly the WC policy is wage based and the company is paying for this injury. Why do they now not want to use it; they can weasel out and avoid an uptick on their XMOD next go around. I remember growing up in a semi rural area when payday came some of the ranchers would just call the INS and deport the workers in lieu of pay as there was always a ready supply.

    We need to work both ends of this problem, the jobs are there and the employers need the low cost workforce; why do we seem to have such a problem on an outcome both parties desire?

    The court is not voiding law it is finding that if you hire some one knowing they are illegally in the country you cannot escape your obligations to them by that fact and must provide benefits MANDATED by state law to your workers.
