that you are a State Farm apologist is not lost. State Farm has admitted they denied slab cases across the board. But you continue the apology route. What part of our legal system do you not understand? State Farm has been adjudicated wrong for doing so. Other companies paid slab cases without being forced like State Farm had to be.

Joe…..Since it appears you have so much time on your hands to write entries under several journals, I would think you could find time to investigate the court proceedings involving the case I posed my earlier question under. For the hundreth time, I happen to believe there are two sides to every story. You appear to have horse blinders on and can\’t see the big picture. If you\’ve got the experience you claim to have, I would find it extremely difficult to believe you would have taken a position other than what State Farm took in that slab case. With that being said, you are no different from their adjusters or the independent ones they hired.
I will give you a chance to educate me, would an insurance company order an engineer\’s report on something other than slab cases? Wouldn\’t it be pretty easy to see what damage was caused by wind and what was caused by water?

The cliams I worked in Katrina had an engineer involved in every structure which had flood/storm surge touch it. 99% of adjusters are not admitted as experts in court, therefore, even as obvious as it seems, a qualified expert is required.

As far as to what poisition I would take, on slab cases,. I have stated many many times that the carriers I have worked for DID NOT DENY THEM. They paid reasonably expected wind damage above the verifiable flood line. That is the crux of my whole argument. I have personally PAID slab cases that SF would have denied 100%.

Did Joe actually answer your questions this time? I posted one to him here:

    http://www.insurancejournal.com/news/southcentral/2007/04/13/78689.htm

and his response in no way, shape or form, answered my question. He just replied again, so I can\’t wait to read his idiotic response. I share it with people in the office who laugh (and cry) over how someone can be so stupid (and blind).

    Jewel,

Unfortunately, he still has not answered any of my questions. He keeps going back to stated, tape recorded message. I thinks he\’s a broken record.
I have a good idea he has done his research on this suit and realizes he would not have done anything different. That would mean, he would fall into the fish barrel with State Farm and would loose all face value.

    Joe,

Thanks for answering part of my question but you again avoided the real question. We all know you are a great Independent Adjuster with over 30 years experience. Your reputation is not the one being slammed here. You have been slamming SF and Nationwide in this entire thread. I want to know how you would have handled this suit after you\’ve reviewed all the information (meaning both sides) not just want is being presented in the newspapers. I can document on two different occassions where the newspapers in Mississippi have withheld crucial information pertaining to the insurance industry in Mississippi to keep this and other issues on the front burner. If they did it then there is no telling how long they\’ve been doing. What I\’m trying to get thru to you, unless you\’ve been privy to both sides of each case your position is again one of \”ignorance\” than of \”knowledge\”.

Hey, it\’s almost pointless to bother… I specifically asked Joe what Scruggs\’ position was with regards to the hurricane damage to his home. He proceeded to lecture me on wind driven storm surge blah blah blah, never ONCE even uttering the words Scruggs, Dickie, the attorney or whatnot. He apparently can not comprehend any questions which do not involve \”Do you know Dick and Jane?\”

He called me the stupidest person on the planet. No doubt he deserves that honor, not me.

    Have a good one David!

part of State Farm did wrong and lost in court do you not understand? What part of the only reason State Farm is doing the right thing now is Ed Rust was within an eyelash of being crimally indicted do you not understand? These two things are FACTUAL. You can play all the stupid games you want but the facts are agianst you. Sore losers usually do as you and make up their arguments. Sadly, the people of Mississippi had to suffer.
