    1) You make things up to suit your case then tell other people they are the ones making things up.

    2) You have extremely poor grammar and spelling skills. Oh, and your reading comprehension is at a 2nd grade level.

    3) You\’re always right, unless you\’re wrong, which is almost all of the time.

    4) Oh, and if you think I am the stupidest person you have ever met, why am I more educated than you? If you made it past 10th grade, I would be surprised.

    I would challenge you to a true test of intellect, but as I already know, you would fail miserably. The first topic could be insurance. :)

    Back to the original article. The jury agreed with the Weiss family, and awarded a very large punitive award…$1.5 million out of a $2.8 million verdict. Apparently it did not matter that the Weiss family received over $400,000 for their damage and it did not matter that they misrepresented a portion of their claim.

    Just when it appeared that tort reform in LA would help clear up the legal environment in LA and make it slightly more friendly, this comes along. It would appear based on this verdict that LA will now be another area where HO carriers will begin restricting their policies.

    No publications have ever stated what the value of the Weiss home was/is. Based on the compensatory award, they had a very nice home. Too bad they did not purchase excess flood?

    On another point, let\’s stop the name calling and p*ssing match about who is more stupid. While we can have differing opinions and positions, what is supposed to make us adults is that we should respect each other\’s opinion without resorting to name calling.

    Can\’t we all just get along? Have a nice day everyone.

    The Weiss residence was approximately 2500 square feet. What\’s it cost to rebuild now-a-days? $125/sqft? That\’s about $315K.

    Apparently the the Time Picayune got the numbers wrong. Bloomberg News reported that the actual award was $1.5MM for the punitive damages and $560K for the property damage.

    That means the jury increased the proeprty damages by $160K over the $400K Allstate had already paid.

    Thanks for the clarification on the damages. They still were overpaid, notwithstanding the punitive award. What happened to the principle of indemnity?

    That\’s nice in theory. But what will you do when adjusterjoe calls you stupid for your post?

    It doesn\’t matter how well written, polite, factual your post is (as yours is for the most part). In my younger days, I had more patience for his sort of ignorance. I wish I still did, but I don\’t. Also, I have had many a friendly debate with posters on here who did not insult me first. If there are no insults headed my way, there will be none thrown back.

    I appreciate your post but doubt we will all be able to get along. :(

    It appears there is a trend developing here with these Engineering Firms. The juries do not like the fact the Engineers are not steeping foot on the property when doing their reports. I can see both sides to this issue. If the juries keep this up, hurricanes will become very expensive with essentially C & O\’s on every policy in force when the insurance company want\’s to defend itself against the claim. Now, the lawyers and engineering firms will be laughing all the way to the bank.

    I have spoken only the truth. I have yet to get any answers or rebuttal based upon facts from the State Farm apologists like you. When I ask a quetsion, it is answered with a question from the State Farm apologists. Here are the facts.

    1. State Farm Denied slab cases 100% without payment. DO NOT ANSWER THIS WITH A QUESTION. IF YOU FEEL IT IS NOT TRUE, PROVIDE PROOF.

    2. State Farm has yet to win a slab case.

    3. State Farm has had punitive awards levied against them in slab cases. Remember punitive damages are only awarded in cases where there is reckless disregard displayed and they are designed TO PUNISH this behavior.

    4. Ed Rust, State Farm CEO, was brought before a grand jury and before the grand jury could bring forth an indictment, he agreed that State Farm would re-evaluate primarily 1000-1200 \”SLAB CASES\” but 35,000 overall.

    5. State Farm has lost a tornado case in OKLA for their questionable use of engineers. This case had a punitive damage award attached. Now there are charges of a similar nature in Mississippi.

    6. The only reason the questions of wind/flood have not been exposed to the extent they are now is due to the prior hurricanes, have not involved flooding to the extent of Katrina.

    7. I personally have paid slab cases for wind damage, so for you to say I would have done the same as State Farm is just a LIE.

    The only responses I have had from the State Farm apologists like you is that the courts are wrong. Hey, if you don\’t want to live by the law of the land, go to Iraq or some other country. This is the system we use in this ocuntry and if your only repsonse is the courts are wrong, then you have no rebuttal for the truth. I know you will not be able to rebutt the truth posted here, but I look foreward to hearing your weak atempts to justify the courts are wrong.

    Joe,

    Here are the answer\’s to your questions that I know of.

    1) Since I don\’t work for State Farm it would be hard for me to answer this question. I do know for a fact that of all the Engineers reports they ordered (likely in excess of 10,000) they paid on over 70%. I guess by your numbers, the only ones they haven\’t paid are the one\’s you cited here. So, let\’s kick the question back to you, Do you know for a fact they\’ve denied 100% of all slab cases? Could a few of these 70% claims paid for wind damage be slab cases? You really don\’t now. I don\’t want to hear some independent adjuster line of crap. You CAN\’T say for sure that all slab cases were denied without payment.

    2) Not sure about this question either, but I can say, not all the slab cases have been heard.

    3) State Farm and Allstate along with some others (when this is all over) will have punitative damages awarded against them.

    4) This was a ploy by Trent Lott who was pissed off at State Farm. Don\’t be nieve enough to think he didn\’t have something to do with this. Just like your great Senator put wording in a recent bill not long ago that Dept. of Homeland Security would oversee the handling of the claims under the NFIP. That is what I want my Security Dept overlooking is our flood claims. Way to go Lott…..keep wasting our time and money.

    5) I know some of State Farm\’s use of Engineering Firms has come into question. Just another political ploy by the plantiff\’s to give their side added advantage in court. You can make just about anything appear how you want it too.

    6) This is really a sad argument for the people in south Mississippi. Basically, they are being told since it didn\’t effect Lott\’s house then he really doesn\’t care. What about all the other people in the so called small hurricances. Sorry, you don\’t count since the hurricane wasn\’t big enough. A storm surge is a storm surge whether it\’s 2ft or 20ft. But the people in Mississippi want to make up the rules as they go along. This is a reason why State Farm and other insurers will refrain from writing any new business or may pull out of the state all together.

    7) For you to make this statement tells me you did not read the case in detail that I had asked you too. Each case is handled on it\’s own individual merits and must be investigated that way. Since you are a independent adjuster, you likely would have very little investigation into whether to pay a claim. Likely, the claim is investigated by the actual company reps who ascertain all the information and then make a descion. So with that being the case, you really don\’t know why the slab cases are denied (which you say they are) outside the fact they are denied.

    Now, what is your hatred towards the largest insurer in the US. Apparently you are very much in the minority. If they are such an awful company then why do to insurer so many people. They take on risks (like coastal communities) that most others don\’t want to touch. They don\’t want to touch because financially they can\’t afford too. I would venture to guess State Farm would love to cover Hurricane (storm surge) among other perils that would directly effect the coast with the proper premium. The insurance policy was approved by the Insurance Commissioner as it was written. State Farm was allocated a premium for that contract. Now they are being told they will have to allocated tens of millions more dollars without actually charging the premium. The people of coastal mississippi know what their insurance covers. Some got flood insurance most did not. Not because of their inability to protect their property they want to blame someone else and why not State Farm…They have money….all i can say, is things have a tendancy to come full circle. I look forward to hearing your next ***** session in a few months and years about how outrageous the insurance premiums are in your state and you call remember back to KATRINA….
