    David:

What felonies have you been convicted of. Obviously you have contempt for our legal system, hence my suggestion that you feel wrongly convicted in your past. Unless of course, your contempt is only based upon your employer not winning in court. Why is the legal system good for everyone but State Farm?

And why is your beloved State Farm so inconsistent. You suggest they don\’t deny all slab cases. If they don\’t deny all, then they would have to apply the concurrent causation clause to some and not to others. Again, when you have something factual come back. It is impossible to have a discussion with someone who only makes it us as he goes as you do. Lets recap according to David:

    1) State Farm applies their struck down concurrent causation clause inconsistently, opening themselves up to even more punative damages.

    2) This is an evil plot by Trent Lott. BTW, why no mention of Gene Taylor? is he not in teh conspiracy?

    3) The fact that previous hurricanes did not have flood vs wind questions, means that the courts should have resolved the question before it was brought before them. I might also add there were questions brought up in FLA from an earlier hurricane about flood vs wind, valued policy, and concurrent causation but the legislature resolved the problem after the courts ruled.

Do you realize how foolish your positions make you look?

    Joe,

How ever foolish I may look, you keep taking the cake from me. Keep posting….

Just so everyone outside joe knows, I will be away from my computer due to the passing of my mother. Joe might get the big head and think I\’m afraid of him which is to the contrary. I hope to be back on-line towards the end of next week. Can\’t wait to hear what stupid things joe has come up with..

    Take care to everyone.

    David

I agree regarding the jury issue. I have been called upon for jury duty 20 times (both criminal and civil)and I am always picked off to not serve. I belive that one stating I was an insurance adjuster and now currently an insurance agent generally freaks out the pltf counsel. They are scared of us.

Everybody know,s The plaintiffs have alleged that\” Many hundreds , if not thousands, of individuals and / or entities have asserted Claims or have potential claims \” Against State Farm. Neither the plaintiffs nor State Farm has given the court any information from which the Court can determine with any reasonable degree of certainty how many policyholders are with in the proposed class or how many policyholders have each

1.) Both engineers in this (the Weiss\’ and Allstate\’s) stated that it is common practice for an engineer to write a report if someone on their staff performs the inspection; but that ideally the engineer would want to visist the site himself.

2.) Anyone actually wonder about the actual cause of damage in this discussion? It sure is a funny that only the houses along the beaches got hit with tornados & not the houses 300 yds inland. Nearly every government publication talks about how destructive the STORM SURGE was, not the TORNADO DAMAGE.

3.) Don\’t forget that the plaintiff attorney hired the Weiss engineer directly. Do you think he was going to hire an engineer that said it was NOT wind? What did he get paid to write his report? He certainly could not be less suspect than the insurance engineer.

4.) How can an insurance company be in \”bad faith\” if they thought they didn\’t owe the money in the first place? Are you operating in \”bad faith\” if you pay $250 for your car repair, but the mechanic later says you owe him $300 and doesn\’t show any proof?
