The Michigan appeals court has a message for an Upper Peninsula woman who was injured while carrying a slice of cheesecake – and it’s not as sweet as the dessert.
The court says Bonnie Campbell has no cause of action against a Holiday Inn in Marquette. She fell after tripping on a serving tray that was extended into an area where diners walked.
Campbell says she wasn’t looking down because she was carrying a slice of cheesecake and a beverage. She says, “The next thing I knew I was flying in the air.”
The court says the obstacle should have been “open and obvious” to Campbell as she was enjoying Sunday brunch at the hotel. The court upheld a decision by a Marquette County judge dismissing the case.
