    It wouldn’t be a bad idea to resolve the matter for “nuisance value” say cost to defend, (or the cost of a package of handi-wipes)

    TxLady. First I would like to say that I am not a clown. I did not call you names, please don’t call me names.

    You obviously miss my point in my posting. If your trying to get the correct size kennel, how do you do this without trying it out to make sure that it not too small or too big.

    Secondly, many PetSmart and Petco stores offfer grooming and vet services in their stores. It’s pretty hard to use these services if you don’t bring the dog to the store.

    As an two-dog owner, I have to agree with those who say there are responsibilities thta come with being a pet-owner but the sad truth is that in today’s litigious climate, the mere fact that someone was injured on someone else’s property is prima-facie evidence of negligence of the property owner no matter whether or not the injured contributed to, or was the main cause of, his or her own misfortune. That is what our legal system has morphed into. And attorneys know that by bringing a case under those circumstances, the insurance company involved will make a business decision to pay whatever it takes to make the case go away because going to court is too expensive today. (Gee, I wonder if that’s the reason we see so many law firms advertising “your rights” on TV.)

    Wouldn’t the reasonable man theory apply here? I think a reasonable man would expect to find dog dung in the parking lot, on the side walk, and in the store.

    first of all, i live near this store. it has grooming service there on site and upfront in the store. secondly, the floors are white and as you know unless he’s drunk a lot of milk of magnesia or marshmellows as some would say, he’d had to have a diahrea. most poop that i know of does not slide it just smooches underneath your feet and you can feel it. most folks would say yuck and find a way to scrape it off. now, he might have tried to do that and grabbed a shelf and fell. as far as animals, many of you said it best, why not take that part of the family with you? what if it happened to be a service dog? it goes into the store anyways. if an animal is kept in a car by itself, it’s a ticket! i was at restaurant, although it was night time and nice, there was a dog left in a car. he was a good alarm to keep folks away from the vehicle, but it’s not right or fair. needless to say, i told management and they called the police. next thing, the spca came and got the animal. the main problem i see is the amount he’s asking for. in the long run, it’s the lawyer who is going to get most of the money. another person said it best, though, because anything can happen and it is going to be tough to identify when management was told about the poop in aisle 4 and when cleanup/marked spot is identified. what if this man had aggravated his back prior to coming to the store? are we sure that his teeth were knocked out by this event? most stores do have cameras, so they can verify many things.

    So what you are saying is the owner is with the dog 24/7 as it can never be left alone, ever.
