    They forgot to mention that the alleged victim also had to have back surgery because this incident aggravated his already bad back, as well as the comment that his attorney made that “his client couldn’t see the poop because it blended in with the floor” Last time I looked, the floors at Petsmart were white, so unless this dog was consuming mass quanities of marshmallows………

    Joe B, how would you like to sit in a hot or freezing car? In many states there are lawas that prohibit this.

    Many pet stores allow pets inside the store to shop. That way pet owners can be sure that they are getting the correct size collar, kennel, clothing, etc. The national chains also provide pet grooming and vet services as well.

    Leaving your pet at home is not always an option.

    Here’s another situation in which plaintiffs’ lawyers are going to be telling people what they can and cannot do. I note the comments from some who say leave your pets at home, but my little guy loves to go to PetSmart to smell all the great stuff they have in there and just for an outing to be with me. There are getting to be fewer and fewer places where pets are welcome, and I see this as the end to the freedom to take your pet into PetSmart as well thanks to a predatory lawyer…gives too much authority over our lives to people who all to willingly abuse it. How about posting a warning that pets are welcome in PetSmart but people should leave their lawyers in the car.

    I’m with you, personally I think we should put the personal injury lawyers on leashes. (or possibly leave them in the car on a hot day)

    PetSmart’s med pay coverage should have covered his medical. That is all he I entitled to but he’s looking for some quick bucks and frankly, I don’t think he deserves any extra money. My son worked for PetSmart for 2 years. Employees clean up poop all the time, plus there are stations all over the store with wipes and bags that customers can get, too. As for leaving Fido at home and the clown who said it isn’t always possible, why is that? Do you live in your car? Does your pet accompany you every single solitary place you go? I know mine does not. Strange story, hurt his back, but broke four teeth. Must have been a very odd fall, or……………maybe embellished?? Like the people who manage to slip on grapes at the grocery store when no one is around?

    I agree, though I have NO knowledge of Virginia case law.

    This is basically true in Louisiana though. The store has to know or reasonably should have known about the hazard. If a jar of pickles breaks and another customer promptly slips on the spilled brine then the store should have no negligence, though a no-fault medical expense coverage could still respond to the injury. If the jar breaks, that customer notifies the manager, and fifteen minutes later the spill is still there and someone slips and injures themself, then the store might be found negligent.

    Also worth noting is the data available for review. Clear CCTV footage is ideal- you can clearly see a timeline of events. Without video evidence mounting a successful case might be more difficult.
