    If courts are going to decide cases like this where people have made an informed decision why not outlaw smoking in the United States? One simple reason is not that the government is altruistic and really cares whether or not someone makes an informed decison, and should be accountable for their decision. No the reason is simply the tax dollars that would cease to exist without tobacco products. It is simpler to blame the tobacco companies. I do not advocate smoking and have been a non smoker most of my life, but that was by my choosing. For over fifty years people have known of the consequences of smoking. Rather than outlaw the product our government would rather be punitive towards the tobacco companies while they happily collect the taxes for all the special projects of the state and federal government.

    People are responsible for themselves and their decisions. We have the freedom of choice….it’s our “right”. But with every “right” comes a corresponding “responsibility”. Too many people ignore that fact. You may have the “right” to use tobacco, but you also have the “responsibility” to control it. It’s no different than liquor and you don’t see class actions by alcoholics against booze makers. It’s not the products; it’s the bad decisions people make….and that’s their “right”. It’s absurd and inherently wrong to reward bad decisions.
