Hundreds of current and former claims representatives of the Progressive Corporation are expected to join a federal collective action lawsuit seeking unpaid overtime with less than a week to go before a court-ordered deadline of March 10.
More than 1,000 current and former claims representatives have elected to join the nationwide collective action so far. The case is pending in federal court in New Orleans, La.
The case was filed in August 2001 by Kelly Marie Camp. A former Progressive claims representative in Harvey, La., she contends that Progressive violated federal law by classifying her and other Progressive claims representatives as overtime-exempt employees.
U.S. Magistrate Joseph Wilkinson Jr. conditionally certified the Camp class action on Nov. 9, 2002.
