A skier who had a bone-crushing fall on the halfpipe at Boyne Mountain has lost a lawsuit that challenged whether the Michigan ski resort had adequately marked the pipe.
A judge in Charlevoix County had declined to dismiss the case filed by skier Marvin Marshall. But the appeals court last week pointed to a Michigan law that says skiers assume the risks unless the dangers are not obvious.
The court says Marshall accepted that danger by skiing in the terrain park at Boyne. Marshall fell over the edge of the halfpipe as he looked for a buddy. He broke a heel, leg, hip, arm and eye socket.
