Ohio Woman Admits to Workers’ Comp Fraud, Ordered to Repay $15K

A Lancaster, Ohio, (Fairfield County) woman was sentenced in the Franklin County Common Pleas Court after pleading guilty to workers’ compensation fraud, a fifth degree felony. The plea came as a result of an Ohio Bureau of Workers’ Compensation (BWC) investigation that revealed Robin Mallory was working while receiving benefits for a workplace injury.

BWC’s Special Investigation Department (SID) initiated an investigation in 2007 after receiving an internal allegation that Mallory was inaccurately reporting the extent of her disability to her physician.

The investigation revealed Mallory received wages from six different employers during the same period she was receiving Temporary Total Disability benefits and she intentionally concealed her employment in order to continue receiving benefits.

Mallory was sentenced to six months incarceration, suspended for a 30 month term of community control, and 25 hours of community service. She was also ordered to pay BWC $15,353.48 in restitution and $2,000 in investigative costs.
