Lawyers for a Cedar Rapids, Iowa, landlord convicted of two counts of tax fraud have filed a motion to withdraw the man’s guilty pleas to mail fraud and perjury.
Robert Miell pleaded guilty to 18 counts of mail fraud and two counts of perjury for allegedly fraudulently reporting more than $336,000 in storm damage on 145 properties to American Family Insurance.
The motion, filed in U.S. District Court, claims the court didn’t follow protocol to ensure Miell’s plea was knowing, intelligent and voluntary. It also cites ineffective assistance of counsel.
The motion claims the court didn’t inform Miell he was facing a maximum penalty of 370 years in prison and a $5 million fine. It also claims the court failed to bring up the possibility restitution could be ordered.
Miell’s sentencing is scheduled for June 7.
