A committee has partially upheld the state’s decision that a former top aide to fallen Attorney General Marc Dann improperly classified workers at his private construction company when determining his workers’ compensation obligations.
Anthony Gutierrez had appealed the decision by the state Bureau of Workers’ Compensation that says he improperly classified four individuals who performed work at MTV Construction as independent contractors instead of as employees.
A committee for the bureau upheld the decision Jan. 12, saying all but two of the employees that Gutierrez had claimed were contractors were actually on his payroll.
The state won’t say how much he owes in restitution.
Gutierrez was a central figure in a sexual harassment scandal that brought down Dann in 2008.
