    the guy was wasted. he knew better than to get behind the wheel and did it anyway. this nonsense of placing blame has got to stop and hopefully the judge who hears the case will toss it out. maybe if hancock\’s father had instilled some common sense in his son he would\’ve known better than to drive while wasted, smoking weed, using a cell phone and hauling *** down the freeway. he\’s dead because he was stupid.

    Why are you people saying you are sorry and this is a tragedy? This is a great! This moron just removed himself from the world before he cause ANOTHER accident and possibly injuring others! You feel bad for his family? Who are suing everyone but the janitor at the Cards stadium? No sympathies from me! When an idiot like this is no longer on the road, I rejoice. When the family looks to cash in on the unthinkable, they too are idiots. Looks like the apple doesn\’t fall far from the tree.

    I\’m not saying that under the law and in a courtroom in whatever jurisdiction, the case does not have merit. What I\’m saying is it isn\’t right. Just because the jury awarded $1.5m for that fire claim doesn\’t make it OK. My point is that cases like these are riduculous, and it\’s the ambulance chasing attorneys that have promulgated the notion that it\’s always someone elses fault – that someone else should have to pay for your stupidity. I think we need to move to a socialist legal system, where the law says that if you file a lawsuit against another party, and lose, you not only have to pay for your own legal expenses, but also for the defendants legal expenses. We would probably eliminate these frivolous lawsuits. I agree Josh\’s family has a case w/merit in some jurisdiction, but it tarnishes Josh\’s reputation, and theirs as well. He was their money ticket, and this case proves it.

    I don\’t see why the tow truck company doesn\’t counter sue for the damage done to the truck.

    And while they are at it, the tow truck driver and the car owner should counter sue the estate for the emotional harm that they have had to endure by watching Josh die and misplaced feelings of guilt. If that driver feels so broken up about the whole thing that he can\’t hold down a job anymore, the Hancock estate should have to pay for that.

    The whole thing is ridiculous and sounds like his father has realized that the millions won\’t be coming anymore and he has one last chance to grab at money and he is going to take it.

    This case should get tossed without any compensation being paid. I have ho sympathy whatsoever for Hancock. He didn\’t acquire his bad habits overnight. Hancock was a 29 year old professional athlete. He was responsible for himself. If fans wanted to buy him drinks and he was dumb enough to take them, get loaded, and attempt to drive a car it\’s nobody\’s fault but his own. Individual responsibility is a concept that has been forgotten. The old man wants to blame somebody other than his irresponsible son. We should not have the duty to protect any adult from their own stupidity. Minors are another story. And yes, I don\’t believe in enforcing helmet or seatbelt laws. Anyone who wants to roll the dice and risk hitting the pavement at 65MPH or going through a windshield has the right to do so.

    The root cause of our litigious society is not the insurance companies, they\’re only reacting to a flawed legal system designed by lawyers for lawyers. Have you ever seen a judge throw a case out for lack of merit? Why does the general public think every injured person is ENTITLED to make a profit? Lawsuits are a lottery for plaintiff attorneys. They have everything to gain and nothing to lose. The more they can exaggerate a simple injury the more money they make.

    Our legal system needs to be reformed to meet the needs of an evolving society. We should adopt the English law rule that if a plaintiff loses, he or she pays the defense costs of the defendant. We should also consider professional jurors as Japan does. Litigation is too important to be left to emotions and prejudices. A professional juror takes college level courses and is certified in understanding of legal principles. They are well paid and their decisions are reviewed. They provide a level of consistency that the general public never will. The sad fact is most reasonable people will do whatever they can to avoid jury duty. Who do you think is left?

    This makes me sick. Not only did he name the tow truck driver in the suit he also is going after the driver of the stalled car!

    The son had twice the legal limit and apparently has a history of this behavior.

    The sole cause of the accident is the Dad’s son choosing to drive while drunk……

    People seem to think it’s alright to get whatever you can in these lawsuits but it only makes the lawyers rich and a few unscrupulous plaintiffs and the rest of all pay for this through higher costs for everything we buy and not just insurance. These cost are absorbed by everyone….

    The father is disgusting. Why did he not teach his son that drinking and driving don’t mix.

    Also, if the restaurant owners knew from prior drinking incidents with him, why did’nt they alert the police that he had left drunk the minute he walked out the door? A night in the pokie might not be fun but may have saved his life and maybe given him a wake up call to his lifestyle.

    Although this is a tragedy for the family, I am just wondering at want point Josh Hancock should be responsible for his own actions. I think his dad is in mourning and I feel sorry for him, but get off the lawsuits and greive for your son. It’s time to realize he was a grown man and that he was old enough to know better…but then again these frivilous lawsuits are what makes our country so great…no matter how much in the wrong you are it’s always someone else’s fault! No wonder our society thinks the way it does. I wonder if these lawsuits would be happening if he was just a “regular person” and not a sports figure…somehow I doubt it.
