    I agree with another stlgirl – you gotta be a lawyer.

    But don\’t stop there – what about the Cards organization? The manager got nabbed during spring training. It took an assistant manager to pull the booze out of the clubhouse.

    What a mess…too bad…

    What about suing the maker of his car? Why haven\’t they created the technology by now that if you are too drunk to drive, you can put your car on autopilot? Or, if they HAVE created this function already, sue them for negligence because it hasn\’t been made available to the public or for rental from a car rental service??

    I feel for the family, but this is getting ridiculous. Even though I feel terrible for saying this, it sounds like the family is realizing the millions won\’t be coming in anymore and better strike while the iron is hot. if my mother and father sued on my behalf the way this family is for THIS accident…i would haunt them.

    The issue now surrounding this unfortunate death is who is to blame?

    Should Josh be blamed for not taking personal responsibility?

    Should the bar be blamed for serving him to much?

    Should the tow truck driver be blamed because he couldn\’t get the broken down car moved in 15 minutes?

    Should the driver of the broken down car be blamed for breaking down where he did?

    Heck, why stop there… let\’s get into really deep pockets.

    Why shouldn\’t the state be blamed. This wasn\’t his first run in with the police. They should have expected this to happen and track him.

    Or maybe we ought to blame the machanic of the broekn down car for letting the car break down again. Heck, maybe even the car maker should be blamed.

    OK fine, let\’s blame the father for not teaching his son when to say no…

    Bottom line, there is only one person that should bare the responsibility of this, and he already has. Don\’t tarnish his memory any more than it already is.

    Can we get back to the impoprtant stuff…this resturant is a very good place to eat, if your ever down in St. Louis and its right next to the ball park…even better for players to stumble too.

    the ultimate responsibility goes to the insurance industry. we, as an industry, are afraid of our own shadows. if we deny coverage we are sued, and all states have bad faith laws that severely punish insurance companies when they deny a claim. attorneys KNOW this and exploit it to the maximum. attorneys know that public pressure will force a settlement, no matter how small, and that makes it worth the attorneys time and effort. the insurance company will settle with the father as it is cheaper to do so than it is to pay THEIR attorneys to fight it and the public relations people to explain it.

    Why is it that we always have to state our opinion? Whatever happened to the old days where common sense ruled and not our justice system. Why do we have to turn a tragedy into a who’s right and who’s wrong thing. We are all grown up’s, we know what happen and yes it shouldn’t of, but it did. My thoughts and prayers go out to all parties involved.

    Why not include the Chicago Cubs as well. After all they had just beaten the Cards that afternoon 8 — 1. What is truly sad here is we have a father who wants to trade the tragic death of his son into a winning lottery ticket for himself.
    That is at best deplorable behavior, as was the behavior of his son leading up to this accident. I hope the defendants and their carriers fight this one to the end and do not just through money at the father to make him go away.

    After all is said and done, and assuming there is a jury trial, it will be the bleeding heart jury who ignores such concepts as personal responsibility, this fine young man drinking to excess and lying to the bar and refusing to take an offered taxi and then killing himself while talking on a cell phone and being unbelted. In many states he will have committed at least five offenses (DWI, speeding, unbelted, cell phone usage and possession of marijuana) and his family is saying it is all someone else at fault. Hello!!!

    Then too, consider his death in that manner as perhaps a good thing – what would have happened if he didn\’t have the accident there but farther down the road running into another vehicles filled with a family.
