The family of a former elementary school student in Bennington, Vt., has sued the school district over a 2007 accident that has left the child with a neurological disorder.
The lawsuit by Amy and Gary Thomas filed in Bennington Superior Court blames the district for the accident that happened when their son was helping a custodian move cafeteria tables. The lawsuit says the custodian lost control of a table while rolling it across the floor at Monument Elementary School, causing another table to crash down on the then-10-year-old boy.
The Bennington Banner reports the suit says Spencer Thomas continues to suffer from neuropsychological impairments and other problems that impair his ability to learn. It asks for unspecified damages.
A lawyer for the district says it was not negligent.
