A Brockton, Massachusetts-area medical group and four doctors being sued by the widow of a man struck and killed by a patient has asked that the suit be dismissed.
Compass Medical and the doctors are accused by Kathleen Vasa of failing to warn an elderly cancer patient that her medication may make it dangerous to drive. The woman, Jane Berghold, crashed her car into Brockton Hospital in October 2007, killing Dr. Mark Vasa and secretary Susan Plante.
The Enterprise of Brockton reports that Compass Medical denied all accusations in the suit in a filing Monday in Plymouth County Superior Court, and asked that it be dismissed.
The group also asked that the case be handled as malpractice, not wrongful death, and requested that a “medical malpractice tribunal” review the case.
