    The fact is, an employee was injured on the job, therefore the injured worker, whether legal or illegal, is subject to workers compensation benefits for the injury. If an employer neglected an employee’s legal status, then the employer is responsible for all ramifications — not the employee. If an employer neglected to have workers comp, then the employer is responsible for all ramifications — not the employee. As an employer, you are responsible for the safety and well being of every single employee regardless of legal status. Not only is this the law, but a basic human right.

    This is not an immigration issue. This is a labor issue!

    I must admit that I’m extremely saddened by the various postings that are nothing short of racist. I wonder, can America ever see beyond the color of the skin? Unfortunately, I don’t think so.

    Ignacia you are barking up the wrong tree! This is a core immigration issue. The very first issue here is that he was here illegally. If he were not here illegally – he would not have gotten hurt and there would not be a labor issue.

    THIS IS NOT A RACE ISSUE – IT IS A LEGAL ISSUE!!!

    i have to ask, who pays the 30k? you say government, i ask who pays our government? bottom line, it’s tax payer money funding this “undocumented immigrant” injury. i’m sorry for his injury but maybe the employer should pay it and not taxpayers who didn’t smuggle him across the border. the burden should be on the employer.

    I know lorie said it, but i want to confirm it!!! THIS ISN’T ABOUT RACE!!! i know some people have used some unfortunate terminology and that frustrates me, but this isn’t about WHERE a person is from, this is about coming into this country ILLEGALLY and STEALING WHAT DOESN’T BELONG TO THEM!

    if you can’t have a grown up discussion about right and wrong, then please, please, PLEASE, do not have children, do not work with children and for the love of god, don’t post!

    You bet Linda. Has anyone in this series of posts defended the action or inaction of the employer. We just don’t think people understand what “illegal” means. It means against the law. This person should not have been here, wherever they came from or whatever race they are. I don’t care.

    Melanie, it’s not true that having a U.S.-born child automatically entitles their parents to remain in the country – in fact, quite the opposite: there have been many instances where the parents were deported regardless of the fact that their child was a U.S. citizen. What is true, however, is that the child cannot be deported under any circumstances: regardless of their parents’ status, any child born in the U.S. is a U.S. citizen, with all the rights and privileges pertaining thereto; and that means that they are entitled to remain in the country. One would hope that parents would take their minor children with them, but the reality is that they cannot be forced to – if they decide to leave the child in the U.S., either a relative or the state becomes the legal guardian (in the latter case, that would most likely involve placement in a foster home).

    Yes, the issue is not race related. That is obvious. Unfortunately, there are several posting that have twisted the facts into a race related issue. That is the point. READ MY POSTING AGAIN – SLOWLY SO YOU CAN UNDERSTAND.

    Again, this is not about immigration it’s a labor issue. As simple as that!

    And who’s stealing? The employer hired an employee, the employee was hurt on the job, and therefore employee is entitled to workers comp benefits. An employee’s legal status does not play apart.

    I will tell you who got screwed on this deal – the hospital and doctors. I guarantee you that they did not get paid . . . The hospital may have received something from the Feds for treating an illegal immigrant, but the surgeon – nothing . . . Illegal immigrants are cheaters and those who hire them are crooks and the American taxpayer gets screwed.
