Settlement Reached in Hawaii Malpractice Suit

The federal government is agreeing to pay $2.5 million to settle a malpractice lawsuit by the family of a 33-year-old man who claimed his toe infection turned deadly because of negligent treatment at the Waianae Coast Comprehensive Health Center.

Attorneys for Chad Kitayama’s fiance and parents say the settlement was reached Tuesday. Attorney Richard Turbin says it’s subject to final approval by the Department of Justice because the health center receives federal funding.

The lawsuit claims Kitayama went to a comprehensive clinic for a lump between his toes. He repeatedly went to the clinic and the comprehensive’s emergency room with worsening symptoms before it was determined he had multi-organ failure because he was allergic to the antibiotic.

The U.S. Attorney’s office and comprehensive representatives couldn’t immediately be reached for comment.
