A jury has recommended that a woman should receive $5.2 million in damages after she was injured when using a cold-therapy device recommended by her doctor who is the head team physician for the San Diego Chargers.
UT San Diego reports that jurors on Wednesday found that David Chao and his company were negligent in their diagnosis and treatment of Whitney Engler, who was 15 when she underwent knee surgery nine years ago.
Engler sued Chao for malpractice after the doctor gave her a cold-therapy device she used for a knee injury. The newspaper said she was later diagnosed with frostbite, which led to permanent injuries, including disfigurement.
The jury is expected to return to court on Tuesday to determine whether punitive damages are warranted.
