A San Diego chiropractor — who was charged with billing State Compensation Insurance Fund for treatment that was not rendered to injured workers and over billed for services — was ordered to surrender her license for 18 months and placed on three years probation as part of her sentence for felony workers’ compensation insurance fraud.
A San Diego County Superior Court Judge also ordered Dr.
Nisha Shanley, 49, of Solana Beach, to perform 200 hours of community service for her conviction on one count of insurance fraud: Penal Code 550 (a) (6). Shanley will be ordered to pay restitution to State Fund on June 21 in San Diego County Superior Court.
Two workers’ comp claimants covered by State Fund sought medical services from Shanley. The claimants reviewed bills Shanley submitted to State Fund and reportedly observed the doctor billed for appointments they did not attend and over billed for appointments they did attend. At least 30 medical visits were reportedly charged to one claimant for visits she did not attend.
State Fund investigated the claimants’ allegations and reported the results of its investigation to the San Diego County District Attorney and the California Department of Insurance (CDI).
Shanley was arrested on June 22, 2004.
