Electronics manufacturer AVX Corp. is appealing a $750,000 verdict in a pollution lawsuit.
A South Carolina jury awarded the damages earlier this month to a Myrtle Beach developer who sued AVX saying groundwater pollution by the electronics manufacturer derailed a condominium project.
The Sun News of Myrtle Beach reported the company wants a judge to reduce the award or throw it out entirely.
The suit alleged groundwater contaminated with a chemical known as TCE hurt property values in a 10-block area near the company’s former plant. JDS Development of Myrtle Beach said the problem caused a bank to withdraw a construction loan for a condominium project.
But attorneys for AVX said in their appeal that the developer failed to present any testimony that there was negligence on the company’s part.
