S.C. Man in Fatal Wreck Accused of Using Fake Pot

Police have charged a Lexington man with felony driving under the influence after they say he tested positive for synthetic marijuana after a fatal crash.

Thirty-two-year-old James Furman Prescott is charged with two counts of felony DUI and reckless homicide.

Police say Prescott drove his pickup truck into the wrong lane of a Lexington street, killing 37-year-old Brady Davis Weed III and injuring his son.

Lt. Matt Davis says investigators found synthetic marijuana was found in Prescott’s truck after the wreck. Davis says lab tests showed Prescott had five chemicals used in the drug in his system at the time of the wreck.

There is no state standard for synthetic marijuana comparable to the .08 percent limit for alcohol.

Defense attorney Henry Taylor would not talk about his legal strategy.
