What is the definition of “loss” in this case? Whether these guys are earning money from fishing or cleaning up oil doesn’t matter. If they’re making an equivalent amount, they are being restored to their pre-loss condition. Are they stupid? Do they think anyone is going to pay them their lost wages & profits PLUS pay them to help in the clean-up. Some of these Vietnamese boys think they hit the motherload. Sounds like BP is at least trying to do the right thing.
Couldn’t agree more…double dipping at its finest! It’s pretty sad that some of the fisherman down there aren’t satisfied with being made whole but rather think they should profit from this mess! Pathetic actually…
A lot of businesses are on a cash basis, but they can prove their loss through receipts, income tax returns, etc. I think many cannot prove their loss because they were not reporting their income – just pocketing the cash. I agree that if the BP cleanup doesn’t pay as much as they previously earned, they should be able to collect the difference. Also, is the cleanup work any more difficult and hazardous than taking people out fishing??
The fishermen and others who lost the ability to pursue their livelihood have every right to fully recover the income they have lost so they end up in the same economic position they would have been in but for the spill. They do not have the right to receive replacement work for which they are being fairly compensated, and then on top of that, claim reimbursement for the full amount of lost profit they lost. This would place them in a BETTER economic position that they would have been in but for the spill. What they are asking for is not compensation, but a windfall. Sorry, that perk is reserved for our elected officials. If you don’t like it, then park your boat and watch as others take on the responsibility of cleaning up the mess and salvaging as much of the future fishing, shrimping, and beaches as possible. Then you can explain to your grandchildren what you did to save the way of life you claim to cherish.
Like the 5 stages of grief (denial, anger, bargaining, depression, acceptance), the same 5 stages appear in the event of a claim. Clearly this is all part of the bargaining stage. It is not uncommon for policyholders to seek a way to profit from a loss once they get beyond the initial shock and anger.

I read that many of the fisherman did work on a cash basis and they can not prove the amount of their loss.
One elected official thought BP should not be strict on the proof of loss required of the claimants.

When they say they were paid on a cash basis they mean they did not pay taxes. No tax return, no proving your income.
