Montgomery County jury has awarded a woman $3.2 million for what it determined was the wrongful death of her mother.
It was the second time this year that an Alabama jury has come back with a more than $3 million verdict against a Baptist health facility.
The award to Kay Davis came after a weeklong trial in the death of her mother, Lauree Ellison, who died on Nov. 8, 2005.
Ellison went to the Baptist Medical Center East emergency room Sept. 3, 2005. A throat culture done during her visit came back positive for Methicillin Resistant Staphylococcus Aureus, a bacteria dubbed the “superbug.”
Neither Ellison nor her physician were informed that Ellison had tested positive for MRSA, so she received no immediate treatment for it.
Baptist Health says it will appeal.
