    Who says the Canadian Medical system is better than the USA? Death by broken knee?
    His last words: “That’s one trip I don’t want to take again.”

    This greedy woman should be happy she got anything. The City Commissioners didn’t want bad press and decided to cough up defense costs to settle. The condition was “open and obvious” and if the old guy was watching where he was walking instead of looking at the ocean this could have been avoided. Plus, he shouldn’t have died from a knee fx. She should be suing her Canuck doctor. There’s also the distinct possibility this guy had other medical issues we don’t know about.

    I’m certainly not a doctor but how does one die from complications from a fractured knee?

    He was flown back to Canada where he died from complcation (after WHAT period of time??) and the city caves! What a country we live in don’t you think?

    He could have died from a blood clot, possible bone fragment traveling in the veins, medication error, obstructed blood flow. Who knows.
    We also don’t know if there is a lawsuit for this in Canada against the doctor.

    i agree, what complications of a knee would cause him to die? sounds like a surgery problem not a problem due to a knee. if i were the city, i’d be asking for an autopsy to identify the reason for death. a broken knee is not a valid reason. as far as walking, since when if we have 2 eyes, we don’t look? afterall, if i were to trip because of a hole in the city park grass – do i sue them for having a hole in the ground? if i walked and hit the curb because i forgot to lift my foot, do i sue the city? this is a ridiculous case, and if i were the city, i would be looking at what complications at the surgery and ask for an appeal.

    1) if in mar 05 was the incident and then a week later he died. possibly 4/05, then why did she decide in 07 to sue? 2 yrs after the fact.

    2) also, if you look, the city sent them by ambulance to canada for the broken knee surgery. what happen to good ole american hospitals? are our surgeons not good enough? something is bogus here!

    Facts based on 30 years of handling claims:
    1. old people are more susceptible to trips, slips, and falls.
    2.they are more likely to have complications from routine medical procedures/surgeries.
    3. they often have pre-existing conditions that contribute to their accidents and complicate medical issues.
    4. they get pneumonia very easily lying in a hospital for a few days.
    5. they don’t heal well.

    As an aside, do you know why most men die before their wives? Answer: because they want to.

    see even you are stating that there might be other things going on here. i still think the city should have sent him to the local hospital, instead of a flight home. afterall, it was an emergency. he might have gotten better treatment in the usa for his trauma. he might have lived to equal his wife’s lifetime. i truly think that 2 yrs is too long to comeback and say – hey! your at fault!
