Insurer Groups: Ruling Suggests Flood Exclusion Valid, Enforceable

    I continue to mrvel at the concept of \”consinsus\” If the masses say it is so it is the law of the land. Never in the history of insurance in the United States has a general policy covered flood and it never will. The cycle is at a fever pitch after ever storm that the people are getting screwed. .. . Nonesense! The policy language changes very slowly and only after some sharpe attorney finds a way to turn the industry on it\’s head. A lot of people along the Gulf Coast have homes that are paid off but you don\’t see them NOT carring insurance. ANYONE in a storm corridor that does not carry the proper coverages is either certifiable or lazy. The more the government gets involved in bailing out homeowners that do not have the proper coverage, the more people in general will accept the fact they DO NOT have to carry expensive policies, the government will bail them out anyway. You and I always bail them out. Wake up America you are paying for lazy people to have a place along the coast and not pay for the risk they are taking living at natures pleasure. The hurricane cycle is high and will be for several years more. It is time America becomes the place it was ment to be. . . a place of opportunity not a place to be taken care of. The latter mind set in peopel can only look to Canida or France to see how that movie turns out.

    It is very clear that Katrina was a very \”weard duck\” but a blanket \”wind caused the damage before the water got their\” is just as bad as saying ALL the damage was caused by flood and surface water. I have seen commerical properties in the Bay St Louis area that were caused 100% by flood as the trees that fell are on top of where the buildings used to be befor they floated away. Each claim has to stand on its own merits or insureance could just as well be done by phone like the guy that always says NO on the credit card miles commerical.

    You sound like you have a lot of good information and it should not be given to anyone. You should make copies that you are willing to part with but you may want to have your attorney hold on to the original copy. I would suggest you place your carrier on official notice that they are at risk of being in bad faith if they do not produce all the information they are baising their denial on. If not, it should not take much of an attorney to take your carrier on. GOOD LUCK. Of course they DID send the denial in writing???

    As I am not an attorney you understand this advise is worth what it cost you.

    My State Farm Adjuster Lied about the Engineering Firm.
    He said, \”State Farm Refuses to pay One Dollar, the Engineerng Firm Said, IT WAS ALL WATER DAMAGE.\” I asked him for the name of that Engineering Firm and he began to studder. He Refused to give me the name.
    Months later I contacted my agent, he sent my message to a higher ranking State Farm Rep. who called me the very next day saying that he is so very sorry and they are going to send another Ajuster to my premises in Bay St.Louis because he has my records in front of him and it does not show that Any Engineer Was Even at My Premises. I said, Sir, that\’s the reason for my telephone call to you, My Adjuster Lied and that\’s also cheating me and stealing from me when I am at the lowest point in my life.
    Needless to say, State Farm lied again, No one came out they had another State Farm Rep call me to tell me that they are not going to pay but they wanted me to mail the video to them and then they would reconsider. lol

    I understand your anger if people witout flood ins WERE trying to GET OVER ON THE INSURANCE INDUSTRY OR ASKING FOR HELP. IF THAT WERE TRUE, I WOULD BE ANGRY TOO.
    It\’s written in our policy. Prior to Katrina…there was always rising flood water w/surges.
    NOT THIS TIME…KATRINA DESTROYED LA AND MS BY WIND AND THE WATER SWEPT THE REST OF THE DAMAGE AWAY.
    Can you OR State Farm Prove that the Water Caused the Damage before the Wind.
    Do you have proof that the flood caused all of the damage.
    I have videos from LA to MS.
    Our US Navy did a geographical Study on Katrina Winds. Ask Thad Cocheran.
    This is proof that 100-200MPH winds from Katrina… hit land from 1 to 4 hours BEFORE THE WATER OR SURGE APPEARED.

    That was their normal pattern.

    They want to blame all the damages on the water and that alone is fraud.
    It\’s a down right lie. Another insult.
    I HOME THAT FEMA CAN SELL
    HURRICANE INSURANCE.
    THE PUNISHMENT TO THE INDUSTRY FOR TRYING TO WIGGLE OUT OF PAYING FOR WIND DAMAGES.
    THEY CAN STICK THEIR ABOVE THE ROOF RULE
    ABOVE THE JUGLER BECAUSE THEY CUT EVERYONE THROAT.

    Why have we not seen these problems in NC? We have had serious flooding on the east coast, both storm surge and traditional \”flooding\” in the past 10 years. We just simply have not seen this kind of litigation and reinterpretation of policy forms. Granted, most wind and hail coverage is written through the Beach Plan, but even standard carriers that insure some of these properties are paying up. I don\’t know about the states you are in, but in NC, you don\’t mess around with the DOI. Maybe that\’s the difference??

    In LA…The Last 3 Ins.Commissioners were sent to jail.
    Now, we have a good man with honor.
    Why fear DOI? Where we come from…

    Can you Prove that water did all the damage?
    Why let the Gov pay for the Insurance Company?
    Not one Flood Adjuster blamed Wind for damage.
    Cool Aid? Play it down and fluff it off but the industry has to be accountable…
    Wind destroyed our homes before the water.

    You have got to be kidding me. RocketMan has both of you dames in this matter. Like it or not, we live in a country that is based on Law. The \”Laws\” are very \”Clear\” on what is covered and what is not covered. If people are Stupid enough to \”Not\” have Flood Insurance in a Flood Plain, than it is their own \”Stupid\” fault when they \”Don\’t have Coverage\”. Simple. If that Sucks, than \”Dem the Brakes\”. I can\’t stand when loosers expect others to pick up the tab for their own irresponsibility. READ IT AND WEEP.

    This is not about flood. Is about Paying High Premiums with an Extra 15% Deductible for Hurricane WIND DAMAGE.
    Katrina was the worst Hurricane in USA History.
    Fact:
    Katrina Winds 100 to 200 MPH…
    HIT LAND 1 TO 4 HOURS BEFORE
    THE WATER, BEFORE THE SURGE

    THE INSURANCE INDUSTRY ONCE AGAIN, (A PATTERN) IS BLAMING ALL DAMAGE ON FLOOD.

    THEY ARE SITTING BACK WITH THEIR POCKETS OVER STUFFED AND ALLOWING FEMA TO PAY THEIR CLAIMS.

    FACT: NOT ONE FLOOD ADJUSTER FM LA TO MS DENIED A CLAIM BY BLAMING WIND FOR DAMAGE

    INS. BLAMED THE WATER BEFORE WE AWOKE TO SEE THE DESTRUCTION. HOW DID THEY KNOW?
    HOW COULD THEY IMMEDIATELY BLAME THE WATER WHEN THEY HAD ZERO PROOF.
    THE WATER WAS THE EXCUSE THEY ALWAYS USED TO COVER UP WIND DAMAGE BUT
    KATRINA BLEW THEIR COVERS OFF.
    TIME FOR THEM TO ACCEPT THE FACT THAT
    MR. WIND DID A LOT OF THE DAMAGE.
    THEY ALSO DENY PAYMENTS FOR
    SECTION D: LOSS OF USE
    THEY SAY OUR HOME IS UNINHABITABLE BECAUSE OF FLOOD.
    ADMIT THE TRUTH…THEY JUST DON\’T WANT TO PAY.
    THIS IS MY ISSUE WITH THE INS. INDUSTRY.
    NO ONE OWES US…EXCEPT THE INS. CO THAT WE PAID TO FINANCIALLY PROTECT OUR HOMES ESPECIALLY FOR HURRICANE DAMAGE.
    KATRINA WIPED OUT MAJOR CITIES IN 2 STATES BUT HOMEOWNERS INS SAYS IT WAS WATER.
    WHAT BLEW THE ROOF OFF THE DOME?
    WHAT BLEW OUT HIGH RISE WINDOWS IN HOTELS AND CASINOS IN TWO STATES?
    CAN YOU ADMIT THAT KATRINA WINDS…
    DID A LOT OF DAMAGE?
    THE TRUTH IS WIND THE THE FIRST DAMAGE THEN WATER WASHED THE EVIDENCE AWAY.

    What about the argument of storm surge? I am not from LA or MS, but I have been around long enough to know that storm surge is the #1 cause of loss to property on our coast in NC. I have seen the destruction hurricanes left, and while there is SUBSTANTIAL wind damage, there is also a lot more damage from the storm surge (flooding). I have heard reports that some homeowners are trying to argue the case that the storm surge is \”wind driven surface water\” and therefore should be covered. Is this something you are seeing in the states effected by Katrina? While I understand your frustration with the insurers (i.e. State Farm) that you are dealing with, not all insurers are handling this the same way. In my state the usual culprit for \”deny first, ask questions later\” tactics is Nationwide, but I have not heard that they are responding to Katrina in the same way as State Farm.
