W. Va. WCC Files Suit Against Trio of Employers

West Virginia’s Workers’ Compensation Commission recently filed injunctions against three state employers whose accounts with the Commission are reportedly in default.

Injunctions were filed in Kanawha County Circuit Court against the following:

* Walton E. Smith, Jr., owner of a Tyler County logging, timbering and lumbering business, owes back premiums, interest and penalties totaling $28,861.33;
* J. T. Industries LLC, a Monongalia County steel erection business, owes back premiums, interest and penalties totaling $37,661.47; and
* Coal Services LLC, a Mingo County general mine site maintenance and building construction business, owes back premiums, interest and penalties totaling $18, 705.62.

Workers’ Compensation Commission Executive Director Gregory Burton said the Commission will continue initiating litigation involving delinquent businesses throughout the state to help assure everyone pays their fair share.

The injunctions call for the firms to cease business.
