Texas’ State Office of Administrative Hearings (SOAH) recently ordered University Health System to pay a fine of $2,500 to the Texas Department of Insurance, Division of Workers’ Compensation (DWC) for late payment of income benefits to an injured employee.
According to DWC, University Health System is a self-insured governmental entity and was considered as the workers’ compensation insurance carrier in the case.
SOAH Decision 453-05-5583.C1 confirms the Notice of Violation(s) served by DWC on University Health System alleging a violation of Texas Labor Code §409.021 and 28 Texas Administrative Code §124.3 and 124.7. The penalty amount was assessed because University Health System was 23 days late in paying income benefits after receiving written notice of an injury.
