Allstate Ordered to Cover Expenses of Rita Evacuees

    The judge didn\’t make his order based on any policy provision. He cannot order insurance payments unless it is based on the policy contract any more than he can order you to buy your neighbor a new car.
    Allstate\’s Texas policy does not have the wording that allows for ALE without damage to the insured property. They applied for that wording in Texas and the ins dept didn\’t approve it.

    You have to look at who the judge is working for. You can tell this by what he acomplished. He knew his order would not stand without an appeal. What he accomplished is to make work for a batch of attornies. This delays payment to people who could or should have been paid and guarantees payment to the attorneys. It also buys time for Allstate to shove their paper around, take notes, and try to hire more adjustors. So…..whatchathink?

    Hal is correct about reconstruction being the longest wait. Stacey, please be patient. Even the best carriers can\’t work miracles. My adjuster came out 2 months after Ivan last year, and I received my ck in December (and I am the agent on my own homeowners policy.) A major portion of the settlement is still collecting interest in a saving account. My house repair is not yet finished. The GC keeps sending out incompetent subs to do the work. I have asked for the third time for the siding to be redone because of shoddy workmanship….. So stacey, you can\’t spend the money even if they pay you tomorrow.

    My Allstate adjuster informed me to make an itemized grocery list with prices, that I would be reimbursed up to $500.00 for loss of food due to spoilage from the power outage, so be sure to ask your claims adjuster about this. They are reimbursing me $460.00 to replace almost everything I lost inside my icebox. Good Luck!

    The whining is getting petty. If you can explain what else you lost I\’d bet the food loss amount would be larger.
    There\’s a $10 fine for whinin\’.

    Oh where to begin Hal, we had about 12 inches of water throughout my entire house, as did the rest of my neighbors. We were not allowed to return for 15 days, so it ruint my furniture, walls, floors, groceries( the least of my worries), doors, trim, appliances, everything inside the house. Mold is growing everywhere and we are currently not living in my house because I have 2 young children (a 13 month old and 5 year old daughter) and my spouse. We sustained roof damage, lost my carport completely, my new privacy fence is blown down, but we are fine, thanks for asking, I will take some wine with that cheese, never mind, that was spoiled because of a direct hit from the eye of the Hurricane with sustained 125 mph winds to Nederland, Texas, which is directly between Port Arthur and Beaumont, TX!!! We have homeowners and flood insurance, but it will be awhile before we are allowed back into our home, want to trade places with me Hal! I haven\’t complained yet, but am frustrated at this point and if I can help anyone with questions about their claims, I will do so as I am educating myself about insurance and what they cover! Oh yes, and I already need ALE since my house is severely damaged and deemed unliveable!! Just ask, I will tell you where to mail the $10.00!! I pay for the insurance, simply put, I want my house put back together the way it was before we were forced to leave and expect my insurance company to pay for it. My adjuster was great, but 2 1/2 weeks later, no check has arrived and nothing has been repaired. I guess we will celebrate the holidays in a travel trailor for now!! Thanks for your sympathy!

    Sorry, my wise crack is out of line. My reaction was that after all the previous terror stories of \”can\’t find your file\” BS and empty promises that an adjuster will be there right away – then never shows up and doesn\’t return phone calls, that being a little short of a freezer-full simply like no big deal. Please accept my apology.
    I hope you get your check soon.

    I accept your apology and at least you are a big enough to admit you jumped to a false conclusion. I am just praying for some normalcy and that Allstate does the right thing and pays for justified living expenses and other structures, at this point, I honestly just want to be back in my own house after almost 7 weeks of being displaced, but that seems very far away. We are estimating to be back in my house by March. All of the contractors are booked and so far backed up it is rediculous, but understandable with so many people sustaining extensive damage in Jefferson County. We just keep saying prayers and ask for patience to get us through these rough times! Regards, Stacey
