Consumer Groups Say Market Forces, Not Claims, Caused Med Mal Crisis

    It can only be imagined how some CEO\’s, and their associates, must be burning up minutes on their cell phones as the damage control machine struggles along to dismiss the, seemingly, undeniable.

    Too, it should not be assumed by the actors involved that the general public, and their legal reprsentatives, are going to forget the unfolding facts in the next three months, or that additional clever advertising will smooth things over socially /economically / legally.

    Interestingly, even local news sources around the nation are looking at the factual methodogy behind some insurers loss claim \”adjusting\” schemes towards home/business owners, and subsequent windfall profits that are manufactured in a stealth-like manner.

    In short, it seems that certain (connected) individuals, intoxicated with illicit profits, are going to have a ongoing and personal \”hangover\” to deal with.

    The name Roger Poe disappeared from the various posting for a while. Bad luck, they are back. Yours are some of the most unbeleiveable piles of hate filled nonsense in all of the communications I have ever read. Another conspiracy nutcase. I am proud of my industry and what we accomplish. There are bad players and badly handled circumstances in any industry. To say that we are all evil people out to cheat everybody is the worst kind of ignorance. Grow up.

    It shames me that I\’m in a profession with such uneducated louts as Mr. Poe.

    Even a cursury reading of the press release will yield a ton of flaws in the study.

    Not the least of which is matching apples with oranges.

    Please believe me not every victim gets justice, and without a proper legal system to keep this in line there will be more people like me. You only really know when you get there.

    I felt compelled to write my story. When I see this name Cigna I still shudder, but I have somehow learned to live with it for now. It has been over 10 years now and I had subscribed to Cigna HMO for healthcare for almost 10 years. I was enrolled and treated in their No. Hollywood wholly owned clinic in California. I thought this was a wonderful company until I got sick and needed treatment. For two years Cigna abused me, and only when I went to outside doctors and paid for it did I learn I had lung cancer, and I went on to prove they knew I was ill and they were simply not going to treat me and let me die. I went to the newspapers and fought them, got treatment and thank God somehow I survived.

    It is a long story. I never did get legal justice because I refused to arbitrate with these criminals, and then they asked the arbitrator to have me pay their legal fees. He refused and said everyone will pay their own legal costs. That day the Judge/Arbitrator said to me, “don’t give up, learn to integrate it into your life, you cannot make this your life, but do not give up,” and I know inside his heart broke for me.

    You bet your bottom dollars these people are, make no mistake criminals, and somehow they are still making a dollar on other people’s pain. However, I am sure justice will come.

    Finally and importantly, I still have the response they filed over 10 years ago, that even if they committed Fraud or a crime they could still compel Arbitration. A sad state of affairs don’t you think? Goverment needs to take action now and holdcriminal actions accountable.

    St. paul,the largest med mal writer was making so much profit from the class that they had way too much money. This became a big problem, how to deal with so much excess capital, so they just decided to get out of writing med mal to avoid such a headeache. Can\’t say that i blame them. making too much profit is really bad business, so it\’s better to get out of the business and give up the chance to improve results.

    Bob, I am an employee of the former St. Paul Companies. As I started to read your email, all I could think was, \”Wow. This guy clearly doesn\’t know how to do his research.\” Then I finished reading and I am still chuckling. Touche.

    It seems the narrowly educated doctrinaire \”free\” market insure-bots want to use \”free market\” as an offensive weapon against any and all others but get all upset when it is used against them.

    Not sure what you\’re saying.

    This study is claiming that the market is responsible for the prices. The insurers agree, however, they also say that the claims crisis is part of the market.

    This study dismisses the claims crisis, but through flawed analysis and apples and oranges comparisons.

    Simple facts such as St. Paul\’s market exit, even though they had the largest market share should indicate the profitability (or lack thereof) of this line of business.

    Furthermore, when these pundits talk about payouts and premiums, they fail to mention that the payouts are for earlier years, and when lined up with the premium that covered that policy, show a substantially different story.

    I hope that med. mal. is more affordable and available in PA.
    I went to a specialist a couple years back. There was nothing I mean nothing to read while waiting for a \”very scarey\” exam. except literature on how the docs. are hurting from med. mal. crisis etc. etc.
