    How can you say…
    We want something for free…
    We Work,
    We Own Homes,
    We Paid for Insurance.

    The Insurance Companies Denied Claims.

    They Refuse TO PAY $1.00 For Wind Damage.

    This is an insult to every Homeowner in America. Hear Our Cry for the Truth to be heard, so that you may learn from out mistakes.

    Katrina winds were up to 200 MPH.

    UNDERSTAND DENIED WIND CLAIMS ?
    FEMA-(OUR TAX$) PAID EVERY FLOOD POLICY TO THE MAX BUT INSURANCE COMPANIES LET THEM PAY WHILE THEY WERE AT THE BANK COUNTING THEIR PROFITS.

    In New Orleans, the wind came BEFORE THE WATER. The water came after the levee broke…that was days after Katrina left.
    Insurance Companies are denying wind claims there too by blaming water.

    Contrary to Your Statement…
    It is the Insurance Industry that got something for free…and not your fellow American Homeowers. Better yet, they took our money and turned their back on us. Loss of use is not in a flood policy.
    They denied that benefit too.

    If they will not pay for a Category 5,
    They will not pay you for one less!

    We Paid them to Financially Protect our Homes for Hurricane Destruction.
    They deny us and refuse to acknowledge that wind caused damage.

    America…Open Your Eyes!

    Listen to The People… Find the Truth.

    I bought Flood and Homeowners Ins,
    The Flood paid the Maximum but Homeowners Ins. Paid $0.
    Denied with lies.
    That is adding insult to injury.
    This is what the suits are about.

    Flood $ 700 yr – $350,000 $500 Ded.
    Ins. $1,300 yr – $50,000 $8,000 Ded.

    We (coastal areas) Pay More but will Never Collect.
    They only pay above the water line. lol

    Surviving without Wind Damage: I would be angry too, you took the steps to properly insure your property. If the insurance company wrote the HO3 with wind, then they should pay for wind damage especially if the flood policy paid for flood damage, your case would be cut and dry, instead company chose to cut and run. At times insurance companies bring many problems upon themselves.
    However, the issue is still why are judges legislating from the bench and mandating insurance companies pay for flood damage on a standard HO3 policy? Judges redefining coverage\’s as they did under the Mierzwa Decision, when the insured declined to pay for a flood policy. That is the true issue of the discussion, storm surging causing damage, isn\’t it flood damage?
    For those of you who took the steps to properly insure your property (as most insurance agents would)then you have a legitimate ***** with the companies. But for the court system to redefine insurance policies after a disaster when it\’s clear the insured did not act prudently to purchase the proper policies then that is a problem.
    Your problem sounds to be different and you should hold the insurance company\’s feet to the fire!

    CHASE BANK is 1st on my list.

    American People Must Know About This,
    so I am trying to help you.
    Learn from Our Mistakes.

    I did not intend to Pay Off my Mortgage in New Orleans.
    Chase Bank continued to mail letters, with commands and demands…
    telling me What They Were Going To Do With My Insurance Money and
    How They Were Going to do it.
    They sent certified letters, hand delivered letters like
    \”They understand my home is vacant.
    They are going to send someone to secure the premises with new locks.
    I told them that We do not need locks,
    we need doors and windows!!!

    No Phones, No business, No Ice, food or water at this time. New Orleans was like the twilight zone – No One lived here.
    We were evacuated for 3 weeks & under water for 3 weeks. We were still in shock.

    Chase wanted me to jump thru hoops to meet their commands… if I wanted my money.
    All Checks were to myself and Chase Bank. I needed their endorsement.

    My home in New Orleans was worth $350,000 before Katrina.
    FEMA sent partial payments in the beginning.
    Oct. 05- $40,000 FEMA FLOOD CHECK
    Chase bank said, This Money was going to be held in a SPECIAL ACCOUNT for me…
    (Zero Interest).
    Then, Chase would give me back $10,000 of the $40,000 after they received signed affidavits from my Contractor, with notarized contracts, and I had to meet their inspections else I had to pay for additional inspections.
    I immediately responded with, Lady Stop, Just Pay Yourself off and Send The Change because I am not in a position to meet your demands.
    Apply the $40,000 to my loan and when FEMA pays the balance, I will pay you off and I will never do business with you again.
    They must have flagged my account.
    They said, I could not do that apply the $40,000 to the principal of the loan.
    IF I wanted to Pay Off The Loan,
    I had to Pay the Balance in Full.
    (I do not have a Prepayment Penalty in the loan.)
    So I waited for FEMA to pay ME in full then I waited for Chase to Pay off and refund balance.

    Over & Over they refused to obey my request for a pay off.
    After 6 months, they said it had to be done in writing.
    They lost the fax requesting pay off.

    CHASE HELD ALL Flood Insurance Money for over 10 Months.
    One time, After I was put on hold and transferred for the 8th time, I stormed out of my office and into the nearest Chase Bank and Shouted…
    I want my money and I want it now!
    The VP could not eveb get the money and she tried.

    I filed 2 Complaints w/the LA Attorney General.

    Chase had to respond and they lied.

    What they say to you on the Phone is different from what they put in writing.

    Chase has a LOST DRAFT DEPARTMENT….
    out of state, and they are set up to
    Buy Time…They are Bandits.

    Some tactics used are below:
    Discontinued Mailing Monthly Bank Statements as of Jan-06
    Refused to Pay off Loan
    Refused to apply partial payments to loan
    Lost one of 3 checks
    Denied ever receiving check When presented with certified mail receipt
    Chase changed their story.
    \”Oh, we found out where you check was,
    we mailed it back to YOU. (lie)
    I asked why would you mail it back to me?
    \”Because it was an Overage\”
    I said, You are lying again because the other
    check was an overage too, so why didn\’t you send that ck back to me?
    Then I said, \”I am Recording This Conversation.\”
    Chase rep said \”well in that case, I have to hang up\” and he hung up the phone.

    They have lots of experience from Florida Homeowners. They are a step ahead of us.
    Mortgages were Paid Off with Insurance Benefits.
    This cost the Banking Industry Billions.

    I have proof in writing… and I haven\’t begun to Fight this yet.

    No, neither home was blown away.
    MS: My Dock & Pier Remained untouched…
    WHY? It was under water and the wind could damage it. A surge would have sucked it all away. The Front & Rear got busted up and all windows blown out.
    I had wall paper hanging from a tree.
    The Metal work shop, collapsed with the porch & roof.
    3 floors fell down and so did the rear of the house.
    Homeowners Paid $0
    I can email pictures to you.
    New Orleans: under water for 3 weeks but MS had 100 times the damage than N. O.
    N. O. home is located 2 miles from the lake and it\’s a 2 story. Roof Damage,
    Broken Windows, Structural Damage on the top floor and Homeowners has Paid $0.
    Loss of Use Benefits: Denied LA & MS
    Loss of Income Benefits: Denied LA

    I am self employed, I live in MS and N. O. well I use too live there.
    My Name is Kim David, I own Private Health Insurance Network.
    I am an Independent Health Insurance Broker. I am successful because I am honest to people. I have never had one complaint filed against me, not in 15 years.
    I am straight up person, and I tell it like it is.

    I am now living in Motorhome. It\’s the 2nd RV that I bought, since Katrina.
    No Fema Trailer wanted here. No one paid my rent either.
    I don\’t want charity.
    Looks like I am going to be living in here for at least another year.
    Can\’t find Contractors. Can\’t Pay for Labor. Keep getting looted but can\’T do a thing about it.
    I am currently parked in front of my home in New Orleans, Lakeview area.
    The true definition of: OUTSIDE LOOKING IN

    We are not stupid people. We are obviously successful enough
    to own a home.
    We are law abiding citizens, tax payers, and now we are held hostage
    by the insurance companies that we paid, that we trusted.
    LOSS OF USE: If your home is uninhabitable-the Policy pays benefits for that
    EX: $3,800 per month or a max of $38,000 per occurrence.
    N. O. Insurance paid $9,000 out of $38,000
    MS Insurance paid $0
    They denied Loss of Use Benefits because they said…
    my home is uninhabitable because of WATER.
    Give Me A Break with the Water Jig.
    I guess They would like for FEMA to pay off that benefit too
    but it\’s not available in a flood policy.

    It\’s like Peeing on my Leg
    then trying to tell me that it is water!

    Justice will be done. It will take time for the truth to come out.
    We don\’t surrender and we won\’t settle for less.
    Until then, we continue to pay Ins. Premiums for homes that we can not live in.

    I have NOTHING to hide.
    My life is an open book.
    In fact, I am writing a book.

    The Saints are going to put New Orleans back on the Map!

    Chase Bank stopped mailing monthly statements. This is keeping us in the dark.
    We have no way of knowing what they have done.
    They are bad.
    They lost checks. They lost written request to pay off loan.
    They used every trick in the book trying to slow pay us.

    LOSS DRAFT DEPARTMENT IS SET UP TO
    STALL PAYOFF.

    The Trial: by Jury,
    The Verdict: PUNITIVE DAMAGES $2.5 MILL
    The Ruling:
    \”the burden of proof was on State Farm,
    and that the plaintiff needed to only
    prove direct physical loss.\”

    First there was Katrina…
    We Lost everything we owned.
    We paid for Hurricane Insurance.
    but State Farm denied it\’s Own.
    While trying to seek some justice…
    we were divided once again.
    Please my fellow American…
    Hear What I\’m trying to say,
    This is not about a
    democrat or republican.
    It\’s not black or white,
    we\’re ALL AMERICAN!

    This is about betrayal to
    Americans… on this promise land.
    It\’s time to stand United again,
    the way it\’s supposed to be.

    Today was a day of victory for the people.

    The Companies we paid & trusted…
    took our money & fled.
    Not only were we homeless,
    we even lost our bed.
    Our Children had No Santa,
    No home to bring a bag &
    They never even cared.
    They blamed Katrina\’s damage
    on water… so it\’s flood.
    They sat back & let FEMA
    Pay Out claims as flood.
    The never tried to help us
    they looked the other way.
    Strangers came to our aid
    but State Farm let is in the rain.

    Today the rain drops are now
    tears in State Farms eyes…

    Now they are willing to settle
    before they do some time.
    Begging Scruggs for Mercy
    when they left us high & dry.

    Who\’s crying now….

    You can\’t do this in America!
    We are Americans,
    This is Our Land.
