A Wisconsin appeals court says a Milwaukee bus driver who chased down a passenger who used a racial slur and spat on him is entitled to worker’s compensation.
Bus driver Isaac Bracey hurt himself soon after getting off his bus to pursue the passenger. Court documents say Bracey suffered a permanent partial disability affecting his ankle and knee.
Bracey and the labor review commission sued after the bus company, Milwaukee Transport Services, refused to pay Bracey’s lost wages, medical expenses and disability payments.
The circuit court ruled in Bracey’s favor, saying the chase was impulsive and insubstantial and shouldn’t get in the way of his claim. The 1st District Court of Appeals agreed on Tuesday.
The bus company’s attorney did not immediately return a phone message seeking comment.
