The family of a man who died along with his wife and son in a traffic accident is suing the driver of the other vehicle in the accident.
Mary Robinson of Holts Summit, Mo., is suing 19-year-old Emily Frakes of Eldon.
Frakes was driving a car that collided Feb. 28 with a vehicle driven by Marty Wilcox of Eldon. Wilcox, his wife and his 3-year-old son died in the accident on Highway 52 near Tuscumbia in Miller County. The couple’s 2-day-old son survived.
The lawsuit claims Frakes was careless and negligent before the accident.
Frakes was released from the hospital on April 6.
Her mother told the Lake Sun Leader hat Frakes feels terrible about the accident but added “That is what it was. It was an accident.”
