A retired New York firefighter has sued the Yankees, saying he was beaten by two intoxicated brothers after they were served more alcohol.
Former FDNY Lt. Richard Kelly says the team is guilty of negligence for his injuries during the May 11 game at Yankee Stadium. He says he was grabbed in a chokehold, thrown down and kicked in the side after objecting when one of the brothers sat in his son’s seat.
Kelly filed the lawsuit Tuesday in Bronx state Supreme Court.
He says he suffers from concussion-like symptoms.
Kelly says Brad Stamler and his brother Keith were served drinks after they already were intoxicated. The two are charged with assault.
Brad Stamler did not immediately respond to a call for comment to his New Jersey office.
