A survivor of a drunk-driving hit-and-run crash is suing the bar where the driver allegedly drank before hitting two people at the scene of a motorcycle crash, killing one.
The Pocono Record reports Robert Scotko is suing the restaurant and bar where Benjamin Warner drank prior to the July 2010 crash.
Authorities say Scotko and motorcycle rider Nathan King were struck by Warner after the initial crash. King died from his injuries and Warner pleaded guilty to vehicular homicide.
Scotko’s suit says Warner was served alcohol at Muller’s Restaurant despite being visibly intoxicated. Police say his blood-alcohol level was three times the legal limit for drivers following the crash.
A countersuit claims Warner was solely responsible for the crash and Scotko was negligent for being in the roadway.
