The New Jersey Supreme Court says a liability waiver protects a gym from a lawsuit filed by a customer who was injured by a faulty bike.
Gina Stelluti signed a liability waiver before joining Powerhouse Gym in Brick.
The form says members assume all risks of negligence on the part of Powerhouse, including injury from malfunctioning equipment.
The same day, Stelluti participated in a spinning class. When she stood on one of the bikes, the adjustable handlebars dislodged and she fell while her feet remained strapped into the pedals.
She suffered neck and back strain injuries and a cracked tooth.
