    How misfortunate! Just terrible.

    I thought that the stand-up forklifts were supposed to be used with either a belt or a hard hat – I would imagine this could be a real ugly Employers Liability claim from his family. A lesson to us all.

    A 51 year old experienced operator should have known how to operate the equipment and use all available safety gear including a helmet and safety belt.

    Sadly, operator negligence is always overlooked in such cases. If he chose not to use the means available there should be no award for damages.

    This employer is in trouble. That man should have had a fall arrestor system on, been trained it it’s use and the taining documented. A lanyard and five point harness would be a minimum. Also, his operator training should have included the risk posed by building obstructions.
