    What is so disturbing about this case is that it sheds a criminal light on business owners with payroll tax problems on account of the recession and the tough California economy. The vast majority of business owners with payroll tax evasion cases with both the IRS and the EDD are honest citizens caught in a bind. My former boss is a perfect example, but he received the help he needed. He went to a guy named Peter Stephan at the Tax Resolution Institute (http://www.taxresolutioninstitute.com/), and Peter negotiated a settlement that allowed him to keep his business and pay off the back tax bill. These criminals shed a terrible light on the good guy business owner with situational tax problems due to economic context.

    Your head is so ______ up!!! I lost my job due to these two idiots! Im a 28 yr veteran of the roofing trade and have never heard of such a thing! I was employeed at petronella roofing by michael himself…and all i have to say is: “what a loser”!!!!!! Oh, excuse me, “what a drug addicted loser”!!!! Those two owe me $2800 dollars for work performed and i expect to never see it!!! Can you afford $2800 bucks?

      Hello Brent this is Michael
      I never was heard in my case. At the time the case broke there was 1.6 million in paid claims and I had paid in over 2 million in premiums. the payroll for Western was insured by another carrier. I admitted i underreported my payroll at my first and only interview with law enforcement the day me and my family were ambushed in my home. The state took and seized everything I worked 30 years to build and then grossly violated my due process rights by withholding material evidence, removing material evidence from the exhibits, falsifying a declaration to deprive me of my primary defense, falsifying a rap sheet, deliberately fixing my trial so I would not testify, illegally seizing all my property, charging me incorrectly on the counts of which I was convicted, after depriving me of my primary defense on why I did what I did. The public doesn’t know that my tax evasion charges were dismissed, theft I was acquitted by the judge because nothing was taken, the premium bills that SCIF made up have been overcharged by 37 million dollars, I was acquitted on every other charge except one that they wrongly charged 33 times. the offense is the lie that one makes that induces the insurance company to issue or renew a policy. I didn’t obtain 33 policies, they knew they charged it wrong. The Department of Insurance knows how the statute was supposed to be charged but they ran for the hills when the case was losing its counts ….because they were simply not true or viable explanations for the conduct…that’s why the counts were dismissed.
      I loved my business and I loved my employees and only underreported my payroll because of an ex-mod rate that was 355% and had i reported all my payroll the ex-mod would have went to .55% meaning I was paying 7 times more for the premium than I should have been paying. that coupled with the fact that the insurance company placed every single employee as a roofer at the highest rate lower wage classification and never corrected the ex-mod as required by law, produced a ficticious premium liability of $38 million dollars, after only paying out 1.6 million in claims and receiving over 2 million in premium. This was all made up paper premiums that to this day have not been decided. All I can say at this point is that the OCDA are legal gangsters and the real criminals. You see Brent they harmed my employees, my vendors, homeowners, creditors by illegally seizing a business based on a ficticious theft of 38 million dollars. They covered it up, slammed me in prison, fixed my trial so I could not testify on my own behalf and got away with it. They screwed this case up so bad that they had to cover it up due to all the damaged they inflicted.
      i am sorry you never got paid Brent as I loved my employees and my customers. I had a workers comp problem that i mismanaged, but me and my family should not have suffered the way we did and only for the damages that would have been necessary to compensate for the civil wrong of misrepresenting ones payroll under IC section 756 . I had an absolute right to defend my liability under the contract in Civil Court, that is the law.
