    I agree whole-heartedly with your take on this…I am no saint but I sincerely subscribe to the concept of adhering to the \”spirit\” of the law. The municipality is hiding behind the letter of the law and continues to harm one of its own constituents: SHAME on those \”public\” servants who continue to chose to not undo this wrong!

    That is a very creative way to address the issue of capping damages. The main reason that caps became popular was to limit the pay out on perceived frivolous lawsuits. Clearly, capping damages was not intended to limit legitimate recoveries but as noted, the pendulum swings in another direction and you get ton of prevention where an ounce was needed.
