A teacher at one of my CE classes, said this about the ethics class requirements:
The agents who are ethical, don\’t need this class. The ones who aren\’t – making them take classes won\’t change a thing.

I would agree that stringent penalties are in order. However, I\’ve seen agents who don\’t want to bother with \”the little stuff\” like certificates, hand off the certificate issuance job to inexperienced, underpaid, under-trained, uninformed clerical staff. Surely we\’ve all seen or heard of \”the certificate desk\”. In most agencies, that\’s the lowest status/pay position around and yet, they hold the life of the agency in their hands.

I have heard of (court) cases that bind the carrier on the representation of the agent. If that is the case, the injured need not worry. It will take some time but they will be compensated. The agent will have to deal with the legalities when the carrier sues for binding them. (lets hope with license termination, fines and criminal charges follow accordingly)
