If the allegations were that the impact h would not have occurred had the bus’ brakes been in proper working order, where was the defense counsel and their expert witnesses testimony? The physical evidence of the loss of control by Covel after being hit by another car should indicate clearly the distances between the bus and the pickup prior to impact. Surely they should have argued that applying the bus brakes, even if in perfect working order, would not have prevented the impact nor rendered it non-fatal to Covel.
Sounds like another instance of poor trial work on the part of the defense.
