Texas House Passes Workers’ Comp Reform Bill

    Thank you Tim for your efforts in attempting to center this fool and his poison. There are far too many victims of this workers’ compensation scheme now to ignore. Allways it seems when the subject of fraud comes up all the attention seems to be focused on either injured workers or their physicians as the perpetators. One independent study I read stated that of the 5 types of wc fraud recognised by TWCC, there was a much greater likelyhood of carrier fraud. Well one thing that is undeniable, is the mother of this entire scheme was fraud, the day Mr. Lonnie Bo Pilgrim walked out on the Texas Senate Floor in the presence of God and hundreds of witnesses and handed 9 Texas Senators, each a check for $10,000.00. That day the bill was passed and sent to the governor (1989) There will never be any meaningful changes to this system until the day comes that business lobbyist are prevented from funding over and under the table the many benefits that our Texas congressmen enjoy, PERIOD! Yes the whole damn system is corrupt, always has been and always will be. Fools like Scott come along bringing with them their limited knowledge and wishful thinking and continue to distort the truth.

    Injured workers are triaged in a sense at the time of their injury. Those with mild injuries usually get what they need and so back to work. Those with much more severe injuries get hell in the form of constant denials and other assorted Bad Faith considerations. Not to mention the usual destruction of their families as well. Consider for a moment, “Lifetime Income Benifits” (for those who are seriously injured) An example under the Texas Labor Code 408.161 is best illustrtaed when a hypothetical injured worker can loose both feet under the ankle, one whole arm, all the fingers on the other hand, total blindness in one eye, severe pertial blindness in the other, the loss of all teeth, 3rd degree burns over 35% of their body and a significant brain injury and yet this person still does not qualify for LIBS. By the way concerning 408.161 (6) there is no legal statute of “imbecility” under Texas law and the last known public usuage of this word was under the 1936 Marital Heath Laws in Nazi Germany, wow.

    This is worse than the Original workers comp Rule that Made it Where you Had to Go to there “Approved Doctors” which were not even doctors but Chiropracters making you worse and Not letting you get the Needed Medical help you need. This bill is Nothing More than Violating the Human Rights of Texans to get Decent Health care after a life altering Work related accident the same Insurances Companies that make and own Texas LAw ,actually they are the Law in Texas, and decent human beings are dieing because of Insurance Paid off Republican Officials. What bis it going to Take to wake Up the Austin “Representive’s of the People Jokes”

    Incidentally, I noticed you\’re a chiropractor and that many posts don\’t have nice comments about their chiropractors. Mine was excellent and I respect your profession to the utmost degree. His name is Dr. Bradley Sikes and his attentive care and attention to detail was more than I ever expected to receive. Unfortunately, with the passing of House Bill 7 and the changes made to worker\’s comp last Sept. \’05, he has given up fighting the system and no longer taking work comp. patients. It\’s a terrible shame that the patients who would have chosen him will never have the benefit of his care.

    Does any body know who we can contact about doctors that are working for the insurance co. It is unreal that every doctor you see that you pay for tells you one thing and then the state comes up with some weidio and he says you are ok but as they are a state doctor they are right?
    I would like to know what the ama has to say.

    Yes at this time my case is waitting going to the B.R.of the state of Texas I wish workers comp issues could go to the regular court system I think justice would be better after two years the state sends out a form that your doctor must fill out and do your MMI rateing they did she did I had a 59% 212 days later the state of Texas sent me a letter telling me I had to go se a DD and if I did not my med and cash would be cut off.I found out later they the insurance co only had 180 days to ask why dint the TWCC pick-up on that? I went the doctor sent the insurance co three I.R. one for 33%-28%-16% well you guessed right they used 16% I lost one of my eyes that was 24% by it self but did the TWCC question any of this no all they told me was a doctor would need to explain well my doctor has said no they are not right and she asked what was up with the three different reports but all I can do is get a lawer that I must pay to question all this ?something that is not legal is going on here and the people in the San Antonio Texas office dont have enough sence to come in out of the rain . They talk like the doctor that they chose could do no wrong why did he file three different reports ?well thats a medical issue that a doctor must explain hey is this it is this the best we as tax payers can get from Austin I also had my head cracked and my brain slipped down my legs both broken my hand smashed but it takes a doctor to explain why three reports were filed .
    The house needs to let people go to any doctor M.D. only they need to pay them the same as all the other insurance co to many doctors have left the system due to low payment there are very few good top doctors left and we are the ones that will suffer do you think the people in the house use these doctors not on there death bed .

    Refer to Kelly post when the steel rod poked my eye out I am sure a chiropractor would have done a world of good?
    If a M.D.want to send you to one thats one thing but to start there no not me.

    Chiropractors also provide guidance with advice designed to reduce work-related injuries. The proper lifting procedures and the therapeutic stretching exercises he can suggest may prove helpful in preventing future injuries

    I disaggreed with this bill because its not in the best interest for texas workers who are out there working 10 hours or 12 hours a day six days a week.just to pay for the sky rocketed gasoline prices that republicans keep defending time in and time out,all america has heard is excuses and lame ones at that for not only gas pump prices but natural gas costs and electric utility costs aswell.it goes to show you that mr. rick perry who thinks he is above the law (this guy asked a state trooper to just let them be on their way after being pulled over for speeding) thinks much like washington supporting big business ,supporting lobbyist ,and taking bribes to put such laws as tort reform bills in to place .im sorry mr.rick perry i find tort reform very un-american ,let me say this loud and clear un-texan ,and very discriminating, why ?you say we have no right to hold a human doctor liable for mis-haps or missed diagnosis of serious health issues .causing millions of young and older workers being left permanately damaged without a right to fight and hold the responsible parties accountable for their mistakes mr. rick perry i hope your staff reads and finds this because im letting you know now not in november i personally want to say it to your pathetic face right now you will not get my vote ,strayhorn will not get my vote,kinky is a joke ,the only one who is qaulified to get my vote is chris bell.why he actually cares about us texans health and well-being he actually took time to e-mail me his office has called me personally its time texas for house cleaning ,rid ourselves of coruption and embarrassing acts such as tort reform hb 7 ..

    My father was a 19-1/2 year veteran firefighter with 2-1/2 years to go before he could retire, when he was struck in the head by a piece of faulty equipment that the City of Grand Prairie had been publicly warned about the month before in the Dallas Morning News. He suffered a brain injury and was not able to return to duty. Like most of you we have had to fight tooth and nail for every scrap of medical, most of which has been routinely denied. The doctors that he has been sent to were horrendous. TWCC found one guilty of something (an injured employee is not entitled to know the outcome), but she was slapped on the hand and allowed to continue her RME’s. By the way, the carrier requested this same quack two years later, TWCC approved it and my father was directed to return to her. Unbelievable. We told TWCC we would forgo any future benefits if forced.

    Anyways, the root cause of all this is voter apathy. On average only 30% of the people in this state vote. My God, how many of those vote for a candidate simply because he or she is cute or because they are the son of their insurance carrier. It is the cause of the rampant corruption in Austin, but your average person doesn’t understand, this isn’t just about corruption regarding workers comp. it’s about every other issue in Texas, from homeowners insurance to school funding. HB7 was passed only because Rick Perry intervened last summer. Afterwards he received his check from Lonnie Bo Pilgrim, $50,000.00, a gift for his election campaign. (Read my June 13 comment) This is the way business in Austin is done. Laws are bought and paid for.

    State Senator Chris Bell is one of the few politicians that have come out and publicly warned us about all this. His staff is the only one that has helped us while others have ignored us. He is our chance to change this, but he needs our help. Please check this out and if you agree with me, make a commitment to yourself to find 100 people that will actually commit to voting for this man. It is high time that the worst rated workers compensation scheme in the nation to be done away with.

    To whom it may concern:

    My name is steven ray sanders i was injured on a job in Denton Texas.. doing some heavy lifting on a hot roof, for a out of state contractor.. A-B Myr Industries. MI i was working along side my Forman ,as we attempted to lift a hood Approx,weight unknown .. but around 1000 lbs i felt 3 pops in my MID BACK . I went to my knees with pain and hardly breathing, My forman and i and 2 other sheet metal journeyman sit for about 30 min or more before i could move. my forman nor the supervisor Greg.. took me to the hospital. or made arrangement.. after 2 hrs .. i finally made it back down to the job trailer,, on the ground.. still no offer to take me to get medical treatment. the point is here how a man was left on a roof with a injury,, and a representative (forman ) made no efforts as to making sure an employee was safe.. and safety and welfare was considered. Two to 3 days after I had to visit the ER because the pain and lack of flex and motion was preventing me to work. today I’m still not working and fighting with the insurance adjuster in my claim… I have followed this up with a orthopedic surgeon.. witch has taken me totally out of work,, 3 weeks later . it took 2 weeks just to schedule the appointment to see this doctor,, at which time i could not work,, after telling my boss ( GREG ) that i could not do the heavy work … and i could not flex. nor lift at which time he said he had no light duty work.. the pain level was to high… i stayed out of work until i could see the orthopedic doctor,, with seeing him .. he agreed that i could not work at all … now going on for 2 more weeks I’m being told the insurance adjuster chad … from Hartford insurance.. or southwest says he is denying me benefits’… I’m going to get avected now from my home,,, and have way to get my daughter to school or put food on the table…. just because of the law and the adjusters rights… to deny anything he can. I HAVE NO RECOURSE that i can get funds to pay bills and eat… Freedom is so nice isn’t it… due to all the regulations and loop holes and the insurance power to simply deny .. i suffer and my family suffers.. thru the tragic events.. until i can seek help .. and get proper representation.
    Who is paying for the time lost at work
    the curebnt system is more for the insurence copanys and employers than the working back breaking americans …
