Does Mississippi not have an UNDER-INSURED MOTORIST POLICY? Uninsured, I understand, this opinion basically says that the other person was not actually Uninsured, and that seems true, but it also seems to say that Mississippi does not require property damage coverage on auto insurance for the purposes of determining if a person is uninsured or not. It doesn’t make good sense to me.
Correction, the opinion does lump UNDER-insured and UN-insured together, therefore the problem becomes that there is no such thing as an UNDER-insured motorist when it comes to property damage liability for diminished value so long as the under-insured motorist had the minimum required limits. So basically, a carrier could exclude any number of legally owed damages by an underinsured motorist from being covered. Still doesn’t make sense.
