This is ridiculous. A well trained, educated and experienced adjuster can resolve first and third party claims quickly, effectively and fairly than a lawyer. Adjusters settle claims, lawyers prepare for litigation. Hiring lawyers immediately in a claims situation that should be resolved by an adjuster is a waste of money. Doing so is an admission you have an ineffective, untrained, and incompetent claims department.

Agreed that this is an issue across the board, but my first thought with Sedgwick making this complaint is, maybe if their adjusters ever returned voicemails or responded to correspondence, their claimants wouldn’t be so trigger happy about lawyering up. Someone please explain how TPAs get away with not having to comply to the same compliance regulations as the rest of us.

I read the entire document. “Liability and Litigation observations and trends 2023 Chris Frechette VP liability practice and Max Koonce Chief claims officer” Their findings are that people are faster to hire attorneys and the judgements against them are getting much bigger. Their solution? Better litigation strategies and they sited a FL law that was near passing that is aimed at limiting the amount of settlements as the solution. ZERO NADA mention of oh ‘return a call?’ Provide a contact number so you can deal with the assigned representative? NOPE.. nothing… so they are basically hoping to change laws to limit settlements vs actually doing their job. Don’t worry the new CEO made almost $4mil last year.. I think that adds up to about 1500 – 2000 people screwed out of their claim for the year. I think my guess is extremely low.. and I left out people who probably died.. but hey that made Sedgwick more money so win right?? That is ALL they care about. Read any lawsuit against them (they are really easy to find). They screw their employees out of pay also – $4mil settlement in CA Case No 21STCV06933 Judgment dated 5/3/2023. There are others in TN and I think KY for stealing employees money.
